Repeal: "Access To Courts"
Category: Repeal | GA #229
Proposed by: Varanius, Co-authored by: Overthinkers, UPC, Obrimenja | Onsite Topic
Replacement: None

We are dismayed at GA#229’s failure to outright prohibit extraction of court costs after a case is complete, thus continuing to allow for money to be a prohibitive element of justice for the economically downtrodden and rendering the resolution functionally useless, even taking advantage of this by going so far as to encourage member nations to allow charging of court costs from the loser
Note: Only votes from TNP WA nations, NPA personnel, and those on NPA deployments will be counted. If you do not meet these requirements, please add (non-WA) or something of that effect to your vote. If you are on an NPA deployment without being formally registered as an NPA member, name your deployed nation in your vote.

Voting Instructions:
  • Vote For if you want the Delegate to vote For the resolution.
  • Vote Against if you want the Delegate to vote Against the resolution.
  • Vote Abstain if you want the Delegate to abstain from voting on this resolution.
  • Vote Present if you are personally abstaining from this vote.
Detailed opinions with your vote are appreciated and encouraged!

For, surprisingly. I actually think it's clever and was considering something similar for repealing hygiene in medical instruments. People should push the boundaries of repeal format more.

Non-WA against for a myriad of reasons that will of course fall on deaf ears because "muh allies".

We should stop pretending we care about resolution quality if we're letting dreck like this pass.

Against: Long standing precedent in judicial circumstances allows successful litigants to reclaim court costs from the defendant. Passing this resolution would in fact impose significant hardship upon successful litigants by removing that option from them. (Think personal injury.) However the text of GA #229 section 3 encourages states to allow successful litigants to recoup court costs, while imposing the requirement that litigants who cannot afford court costs be allowed to bring their case at reduced or no cost.

Repealing 229, and I can't believe that as the Leader of an Authoritarian Regime I am saying this, Would be a significant reversal of key human rights.

Vote Against.
