Conspiracy to Commit Gross Misconduct
Gross Misconduct
Specifics of Crime(s): The above named accused, did conspire to commit Gross Misconduct by attempting to make changes to the final results of the May 2023 General election via a nonpublic action in violation of the law and the Election Commission rules, individually and as a whole. The above named accused, with the exception of TlomzKrano, did commit Gross Misconduct by conducting Election Commission business outside the public eye and in violation of the Election Commission rules.
Summary of Events:
The May 2023 General Election is a legally required election to select the next serving delegate. Dreadton and Lore were selected by the Chief Election Commissioner to supervise the election. At the close of the voting period, the Election Commission has 6 hours to review and privately challenge ballots. Historically, minor errors and vote changes are caught during this time. On occasion, Election Commissioners will actively participate during the voting period and catch such errors. In this election period, no Election Commissioners participated, outside the two supervising Commissioners. During the challenge period, some errors were found and corrected by the two Supervisors. The sole election commissioner to certify the election was Pallaith (Ghost). No other Election Commissioner commented during the voting period or the challenge period. At approximately 2:15pm CST on May 11, 2023, the Election Results were automatically certified and the Results presented to the Region. The spreadsheet where the votes were tallied was locked and all edit permissions removed.
On May 12, 2023, at 2:58 am CST, Ghost messaged the Complainant on Discord about some discrepancies he discovered after the results were published. The Complainant did not respond and undertook a review of the law and rules in order to determine what if anything needed to be done, once the message was viewed. On May 13, 2023, Lore reached out about the issue. Lore stated they would have changed the results but their access was cut. Lore then stated, a few hours later, that they had talked to Sil and “They are as far as I know of the mind that it can't be fixed after certification but there is no actual laws or real rules about certification.” The complainant responded, “Does it change the outcome of the election? If not I think a citizen has to challenge each of those.” Lore acknowledged it did not change the outcome and gave some thoughts on the relevant law.
On May 17, 2023, the complaint was messaged via Discord from Sil Dorsett. The Message stated, “I've been getting a lot of messages regarding the results of the last election being inaccurate, and after talking with Lore, Ghost, Gorundu, and Court Examiner Tlomz, what
we believe should happen is to make the corrections on the spreadsheet and results page and just take an r4r to clarify what should happen if the posted results are incorrect. Can you make the corrections Lore brought up or restore his editor access to the counting spreadsheet to do that?” (Emphasis added) The complainant stated they would restore Lore access as they were not willing to change the vote. He further included that one reason was that the challenge was not done in accordance with Rule 7.2. At this point, access was granted to Lore. Sil acknowledged the rule and stated they would have Ghost place the challenge on the forum. On May 18, 2023, the complainant spoke to a former bar commissioner. They pointed out that granting access may be considered Gross Misconduct under the law, as the results were final and no changes can be made. The Complainant saw no edits to the sheet and removed access from Lore. The Complainant notified Sil Dorsett that he would not be willing to unlock the sheet.
The Complainant does allege that the above facts and attached screenshots, establish the Defendants in this matter did Conspire to Commit Gross Misconduct. The law on this matter is clear. Challenges regarding ballots must be done during the voting period and during the 6 hour Challenge period after. The Election Commissioner may modify how each ballot is counted Until they certify the final results. Further, Election Commission rules require that all official business of the Election Commission must be done publicly, with the exception of the challenges during the voting period and the 6 hour challenge period. For the reasons listed, the Complainant does allege that all parties Conspired to Commit Gross Misconduct by Planning and Attempting to change a final and certified election result. Furthermore, The Complainant does allege that all parties listed, with the exception of Tlomz, did commit Gross Misconduct by conducting Election Commission Business outside of the public eye.
