Hate Crime Prevention and Enforcement

The World Assembly,

Recognizing the necessity to protect against crimes motivated by hate or prejudice, which cause serious harm not only to their victims but to the communities at large to which they belong,

Now enacts the following:

  1. A hate crime is any criminal act for which it can reasonably be determined, based on direct or circumstantial evidence, that the crime was motivated, in whole or in part, by the offender's prejudice against the victim's personal attributes including but not limited to ethnicity, nationality, cultural or religious belief, gender, disability, or sexual orientation.
  2. Member nations shall provide for the purpose of ensuring that, if a motivation of hatred is established in accordance with appropriate legal standards, it can be made an aggravating factor in sentencing or other appropriate reaction to the offense. No state shall be obligated to create evidentiary burdens contrary to fairness or due process in their systems.
  3. Nothing in this resolution should be interpreted to mandate or authorize the criminalization of legal expression, peaceful political dissent, or the holding of unpopular opinions, so long as such expression does not directly incite criminal conduct.
  4. Member nations shall take appropriate steps to prevent the abuse of hate crime legislation for political purposes or to suppress legitimate dissent and shall maintain procedural safeguards, including judicial oversight and the right of appeal, to avert such misuse.
  5. The World Assembly encourages systematic review of national legislation on hate-motivated crime with a view to promoting fairness, consistency, and compliance with civil rights while facilitating flexibility to fit into various legal systems.
