Restoring Workplace Discrimination Protections

Affirming that, despite the arguments of GA#783 "Repeal "Preventing Employment Discrimination,"" discrimination at work is an inherently international issue, not only due to the international nature of many organisations and workforces but also due to this body's historic record of protecting the most vulnerable from discrimination, and

Believing that preventing employers from conducting unwarranted discrimination will enhance their international competitiveness as their pool of potential employees and candidates for promotion is opened up to a wider range of meritorious individuals, including those from diverse backgrounds and cultures...

The General Assembly hereby:
  • defines, for the purposes of this resolution:
    • "personal characteristics" as including only age, sex, race, religion, sexual orientation, gender identity, disability, social class, financial or property-owning status, and
    • to "discriminate against any individual" as refusing to employ any individual, refusing to promote any individual, and removing any individual from their employment,
  • forbids all employers in member states from discriminating against any individual because of their personal characteristics, except where such discrimination is:
    • age discrimination done to ensure compliance with any applicable child labour laws,
    • conducted by a religious organisation, in the course of hiring that individual to discharge duties directly relating to its religious work, in accordance with its sincerely held religious beliefs,
    • done because that individual's personal characteristics render them unable to deliver the full spectrum of that role's duties (for example, those unable to walk in the context of a job requiring the employee to regularly take part in rescues),
    • employing that individual, where they have a personal characteristic and will undertake a role the primary duties of which are directed towards clients sharing that personal characteristic, or
    • permitted or required by prior and standing international law not relating to child labour,
  • clarifies that, when an employer announces a public intention to discriminate against any individual because of their personal characteristics and for any reason not specified in Articles b(i-iv), such as by publishing an advertisement categorically declaring that no member of a racial minority will be employed by them, such an announcement must be treated as though it were a violation of Article b,
  • demands that, where a foreign national is employed in a particular role in a member state and is legally authorised to do so, that member not deny them entry for the purposes of delivering that role because of their foreign nationality or personal characteristics,
  • requires members to enforce this resolution within their jurisdiction, and to co-operate with other relevant members where violations across international borders are alleged, and
  • emphasises that this resolution shall not be read as requiring or forbidding the use of affirmative action in any context.
