The World Assembly,
ACKNOWLEDGING the noble intentions of GA#738: “Aircraft Terrorism Prohibition”, a resolution seeking to improve the handling of cases of aircraft terrorism,
DISMAYED that the target resolution fails to address this topic properly, and otherwise contributes to unnecessary bureaucratic strain instead,
CONCERNED about several clauses that allow member states to claim jurisdiction in cases where they should not, including:
Section 6c, which lets WA Member States claim jurisdiction over any case involving any amount of property damage to property of that member state, which may include passports, regardless of scope of damage or cost,
Section 6d, similarly letting WA Member States claim jurisdiction if any of their citizens happen to be injured during an offense,
NOTING that the target resolution does not govern “any conduct during wartime, whether such war is declared or otherwise”,
OBSERVING that this exception is not limited to actions taken as part of the war; so long as an entity is part of any war, formally declared or otherwise, any actions undertaken can be considered ‘conduct during wartime’,
ASSERTING therefore this allows entities to engage in otherwise prohibited behaviour and still profess compliance, undermining the effectiveness of the resolution,
ALARMED by Section 8c, which grants the WAJC jurisdiction on “any acts for which a non-WA state has voluntarily abandoned assertion of jurisdiction”,
WORRIED this wastes member nation dues as the WAJC would be required to investigate any case where a non-member has ceded jurisdiction, even when no entities involved in a case have any relation to the WA, or a WA member state,
HORRIFIED that the clause amounts to an unjustified power grab by the WA, as it is able to assert jurisdiction even in cases where no party consented to its involvement, and
CONCLUDING that this resolution impedes the process of prosecuting aircraft terrorism rather than aiding it and should be struck from the record,
Hereby repeals GA 738.
