All,

Candidacy Declarations for the January 2025 Special Judicial Election were declared closed on Tuesday by mistake instead of Wednesday as it should have been.

The question is how to resolve the issue.

I am leaning towards reopening declarations for 1 day, followed by the normal two day campaigning. If there's any question about the legality of it, we may have to restart entirely. Thoughts?

I do not believe restarting is necessary, I think Sil's approach is fine. There is no legal remedy for handling an accidentally prematurely closed nominations period. And there's this:

17. The Election Commission will have the power to make rules for the supervision of elections. Where no rules exist, the Election Commissioners supervising a given election may use their discretion.

The commissioners can make the call on how to correct this, and any citizen can petition the decision and have the full commission weigh in on whether we agree with the action or want it to restart. We're jumping ahead to the next step, in my view.

The reason I come to the same conclusion as Sil is that legally, this nomination period has to be 3 days. Closing it early means you need that last day. As long as the election begins two days after the end of this period, we are on schedule. The election began when legally prescribed, and it must run through the stages in the appropriate order and the right amount of days being offered. The law does not say it has to run within a set number of days, only when it must begin and how long each stage is. While nominations are prematurely closed, the proper amount of election time is not occurring. This has the effect of delaying the conclusion of the election for exactly how long it takes you to reopen the thread and complete the nomination period. Restarting the election from the beginning would be an unnecessary waste of time.

I agree with Ghost in this case. I believe that we should simply re-open nominations for an extra day, then begin voting two days after that. That way, we ensure that the elections runs as it is legally intended to. Re-opening the election would be unnecessary and drag on the process far longer than it needs to be.
