[Chambers] Indictment of St George

Copying this over from Private Chambers.
I will serve as Moderating Justice, Justice @Eluvatar will serve as Standby Hearing Officer. As Pallaith is recused in the matter, @Sanctaria will serve as Temporary Hearing Officer.
This is out of order in two ways:

1. It's up to "the remaining justices" not the Chief Justice alone to appoint a Temporary Hearing Officer. You needed to co-ordinate with me about appointing a Temporary Hearing Officer.
2. The Standby Hearing Officer is not a designated Justice to individually hear requests for review, they are a pre-designated THO in the case that the Moderating Justice does something that gets R4Red, necessitating the Moderating Justice's recusal. You need to appoint someone who isn't me, Pallaith, (presumably) Sanctaria, or Dreadton to that role.

Correct, you would need to speak to admin to get that set up. I recall this being done when I was recused previously.
I can take care of that.

Edit: Pallaith should no longer be able to see this area.

Ah, I assumed this had been agreed by you and AS before he appointed me, my apologies. Given I have taken the oath and been remasked, I hope you have no problems with my continuing as THO?

I'll have a private conversation with AS. I don't object to you personally/particularly as a possible THO, and I'm glad that you are clearly available, but I want to at least go over the process.

Yeah, as I said in PM, it was a lapse in judgement.
However, as I've been asked to recuse myself, I have to hand over the case. Obviously, being recused I don't want to influence the case while doing so, but as CJ I have to appoint a moderating justice and a SHO. I suggest Eluvatar as moderating justice, and I'll take suggestions on the SHO.
 
That's a fair comment. Maybe @Eluvatar also has ideas. What about someone like Fiji? Not sure on judicial experience, but trying to think of a normal citizen without a potential or actual conflict.

A number of people have made comments on discord about the case - at what point would we consider those potentially a conflict?

In addition, as AS was asked to recuse because of serving in the Executive Branch, we should rule out all Deputy Ministers/Ministers too, I feel.
 
Ministers aren't valid choices because of the separation of powers clauses. Deputy Ministers are typically appointed by Ministers, not the Delegate, and are generally not considered high enough in the executive to fall under that.

The defense was particularly concerned that Attempted Socialism, as Deputy Minister of Foreign Affairs, had a potential conflict of interest. Granted, their reasoning about serving under Delegate Gorundu would indirectly apply to any Deputy Minister, or even conceivably any member of the Executive Staff, at which point I'd need to recuse myself too as a member of the FA and WA staffs. I don't think that that is appropriate as I am far more concerned with my oathsworn responsibilities as Justice than my ability to give advice in those spaces. Deputy Ministers (outside Foreign Affairs) are more of a grey area. I can try to annotate my above list before winnowing it to make clear what the situation looks like.

I would avoid based on commentary only those who've expressed an opinion on their preferred outcome of the case.

I think GBM is very fair, and I already mentioned Fiji, so they'd be my preferred options.
 
Ok. My understanding then is Fiji wouldn't participate at all unless you had to be recused, correct?

Also I believe we're still waiting on Gorundu to appoint a prosecutor.
 
Either are fine with me. Oracle ran in the last judicial election so maybe ask them first?
 
I am standing down as THO due to time constraints - I thank the Court for appointing me to assist them in their duties thus far, and wish them the best of luck going forward.

Do you want to make a statement to the effect that the search for an unbiased citizen to serve as a THO is ongoing? Just so folks don't think we've forgotten about it.

I *could* reach out to some of the Deputy Ministers I skipped over: @Simone_Republic, @Caius, @Cloud, or @Magecastle. I'd prefer not to reach out to more than two at a time, but I could reach out to all four and see who responds first...

I am open to holding the position if the Court wishes to appoint me to it. To the best of my knowledge, I have not made public or private comments explicitly advocating for a certain outcome to the trial. However (1) I do not have much experience with the regional court system; and more importantly (2) I currently serve in a Deputy Minister position for the WAA ministry. Given that Attempted Socialism recused themselves due to their being a Deputy Minister, I believe this will likely be an issue which would affect such an appointment.

I am inclined to ask them to serve. @Great Bights Mum do you think that makes sense, at this juncture?
