Tristain to hold independence referendum, Imperial Government responds negatively to announcement

This morning, Tristainian premier Jean-Marie Devereaux announced that the region of Tristain would hold a referendum on 1 February to determine whether it would declare its independence from Mintoria. This decision comes as many in Tristain call for the region to become a sovereign state. The premier stated during his address to the region’s National Assembly that “this was something that the people had been wanted for a long time. He also stated that “it was time for Tristain to hold a vote on its future, and to let the people of Tristain decide who they wanted to be.”

The region became part of Mintoria when the Tristainian crown was merged with the Imperial crown in the year 1847 with the Act of Union which was passed into law following the Tristainian War. Relations between the Tristainians and the rest of Mintoria have become strained since the Act of Union, with calls for independence only increasing after the end of the Fascist War.

The announcement has triggered a negative response from the Imperial Government, with many officials within government stating the referendum was against the Constitution, which does not provide for regions to break away from the realm. Imperial Chancellor Wilhelm Städtler, in response, stated as much in the following:

“The constitutional laws of this nation does not have provisions for a region to declare itself to be a sovereign nation. To hold a referendum for independence would be to directly violate this nation’s constitution, which we hold dear and which we will uphold fully to the letter.”

It is not known what actions the Imperial Government will take. It is likely that this matter will be referred to the High Constitutional Court. If so, the decision on whether the referendum is legal will be determined by the Court.

The Imperial Constitutional Court today at 13:00 issued its ruling on the independence referendum to be held in Tristain. It ruled that the referendum in question was unconstitutional, and that the Tristainian regional government had no authority to hold the referendum.

In its ruling, the Court mentioned that the Imperial Constitution made no reference to self-determination or the right of any region to declare independence. However, it referred to Articles 1 and 2 of the Constitution, and mentioned that the country was formed as a unitary state and as “an indivisible, inseparable, and indissoluble Realm,” implying that no region could leave and become independent. It referred to Article 105, which gives the Imperial government the power to grant regions some authority, and stated that the government did not grant Tristain the authority to hold a referendum. Additionally, the Court, in its ruling, referenced a 2018 decision from the Plembobrian High Court, which declared the Crilalian independence referendum to also be unconstitutional based on similar reasoning.*

The ruling comes after several days of deliberations, and only just a few days before the day the referendum was set to take place. Those in favour of Tristainian independence went out to protest the decision from the Constitutional Court in major cities across the region. The Tristainian premier Jean-Marie Devereaux expressed dismay and disappointment in the ruling, as heard in the following:

“The people of Tristain wish to have a say in their future. The decision by the Court is essentially the State taking away their right to choose.”

However, he went on to state that the regional government would not be deterred, and that they world ensure that the referendum would continue as planned in spite of the ruling.

Meanwhile, in the chamber of the House of Deputies, Imperial Chancellor Wilhelm Städtler expressed his reassurance that the laws of Mintoria would always work as intended, and stated that the decision of the Tristainian government are in direct violation of the Constitution, and will be dealt with appropriately. The Imperial government has issued a warning to the Tristainian premier and members of the regional government not to move forward with the referendum, lest more forceful actions would be taken to ensure compliance with the Constitution.

Violence has started to erupt in major cities in the region of Tristain as the Imperial Police and the Imperial Gendarmerie commences a crackdown within the region. This is in response to the actions of the Tristainian government, which announced that they would move forward with the independence referendum, despite the Imperial Constitutional Court ruling against it. So far, security forces have stormed polling stations, confiscated ballot boxes, and have moved to prevent people from participating in the referendum, through the use of force.

In spite of these measures, the Tristainian premier Jean-Marie Devereaux has insisted that the referendum will press on, and that the people will vote. In Glaienbeck, the Interior Minister, Ulrike Brümel, has stated that stated that the measures were ordered to ensure that the rule of law provided for under the Constitution was preserved.
