Noting the well-intentioned purpose of GAR#18 to ensure the ethical treatment of Prisoners of War (referred to as PoWs in the resolution) and civilian and military internees,
However dismayed at the impracticability and absurdity of many of its clauses, including:
- (1)(b) mandates the supplying of clothing and/or “replacement uniforms” which cannot bear markings distinguishing the individual as a Prisoner of War, despite the impracticability of creating replacement uniforms with duplicated insignia for those in custody,
- (1)(c)’s requirement for PoWs and internees to be provided methods to contact & be contacted by relatives & friends in their homeland fails to account for the disparity in technological advancement across the Assembly, where not all nations have means of readily contacting individuals in a hostile nation,
- (1)(d) mandates that all PoWs and internees must be supplied with a blanket “protection from insults,” an absurd demand that cannot be enforced without completely isolating these individuals from anyone who may insult them,
- (2) prohibits PoWs and internees from undergoing medical procedures not required to ensure their health, regardless of if such a procedure is desired by the individual,
Bothered by the loopholes in GAR#18 that allow for nations to circumvent some of its intended stipulations, such as:
- (1)(a) requires PoWs and internees to be supplied with “water” and “fully nutritional food,” but doesn’t require them to be supplied with a minimum amount to ensure ethical treatment,
- (1)(c) mandates PoWs and internees to be supplied methods by which they may contact and be contacted by relatives & friends, but allows for unrestricted censoring of correspondence anyways,
Highlighting the possibility for passing future legislation without exploitable loopholes and absurd clauses on this topic,
Hereby repeals GAR#18, “The Prisoners of War Accord”
