Voting Rights Guarantees

The World Assembly (WA),

Defining:
  1. "bod(ies)" to mean any body/bodies of government in a WA member state with legislative, judicial, consultative, or other powers (substantive or otherwise) at national and/or all sub-national levels;

  2. "election(s)" to mean elections for representatives to the said bod(ies), including any preliminary elections, or consultative meetings for choosing representatives such as caucuses;

  3. "voters" to mean anyone who is eligible to participate in the said elections, notwithstanding that a registration process may be required by a member state prior to participation;
Hereby requires:
  1. No one in any WA member state that is otherwise eligible to be a voter shall be denied the right to vote (and/or to register to vote), for any bod(ies) on account of the following immutable characteristics:
    1. Current status of incarceration (including work release, parole, half-way houses and home confinement);

    2. Previous records of incarceration (including parole) and criminal conviction;

    3. Failure to repay any debts due in full or in part (including liens, fines, penalties, taxes and fees payable pursuant to any legislation or regulation at any level of government);

  2. Any interpretation of this resolution by the judiciary of a WA member state shall be for the benefit of anyone who would otherwise be denied the aforesaid rights.
Note: Only votes from TNP WA nations and NPA personnel will be counted. If you do not meet these requirements, please add (non-WA) or something of that effect to your vote.

Overview
This proposal serves as a replacement for the repealed GA resolution #419 (Voting Equality For Freed Inmates), along with patching the current GA resolution #476 (Protecting Borrower Rights). It seeks to guarantee voting rights in elections for otherwise eligible individuals that are currently or have previously been incarcerated, or have failed to repay taxes and tax liens. The proposal prohibits member states from denying these individuals the right to register for voting and vote.

Recommendation
Voting and registering to do so are fundamental rights of citizenship in a country. Denying those rights to currently and previously incarcerated individuals, along with individuals indebted to the government, violate their rights to represent their voices in the process of democracy.

For the above reasons, the Ministry of World Assembly Affairs recommends a vote For the General Assembly resolution at vote, "Voting Rights Guarantees".

For. If this passes, I will likely draft a companion proposal to extend similar protections in referenda (rather than only elections).
As mentioned gameside, I have to work with the confines of GA#579 for the purpose of elections. If you go for a separate resolution covering referenda, plebiscites etc, probably can be more extensive and actually a "furtherment of democracy".

I am present. Much as the proposal does impose good regulations for the proper regulation of democracies, there is no mandate for a nation to be democratic across the extant corpus of the GA. It feels odd to mandate that, when a nation is democratic, it is so to a maximalist extent, while also allowing a nation to be minimally or maximally dictatorial.
