Recognizing the right to an adequate standard of living and the right to science and culture, particularly the rights to food, clothing, housing, education and art,

Recognizing the social function of cooperation with mutualistic nature and without purposes of private speculation,

Recognizing the rights of workers to collaborate in the management of economic activities,

Noticing that unregulated economic initiative can be conducted in conflict with public weal or in such manner that could damage safety, liberty, and dignity of persons,

Determined to protect the social function of personal and collective ownerships from private speculation,

The General Assembly,



  1. Definesfor the purposes of this resolution:
    1. "person" as an individual whose personhood is legally recognized in a Member Nation,
    2. "family" as a group of persons related by affection or kinship who share housing or material needs,
    3. "cooperative" as a voluntary association of workers or users following mutual and democratic principles,
    4. "ownership" as a system of rights that gives legal control of a thing,
    5. "possession" as the practical control of a thing even without the ownership of it,
    6. "material needs" as the basic things that are necessary or helpful for health, water, food, and shelter,
    7. "cultural needs" as the basic things that are necessary or helpful for education, arts, and entertainment,
    8. "social function" as the contribution to the collective or common good to benefit society as a whole, and
    9. "social objective" as a desired outcome of a project to improve well-being of persons and interaction of individuals, groups, and institutions within a society;

  2. Identifies
    1. "personal ownership" as the ownership by a person of the following things, hereinafter referred to as "personal goods", that is aimed at the sustaining of the person and the person's family:
      1. income and savings deriving from the person's work,
      2. dwelling house,
      3. small cultivation,
      4. goods and objects useful for satisfying the material and cultural needs of the person, and
      5. means and instruments of personal or familial work, and

    2. "collective ownership" as the ownership by a group of persons or a cooperative of the following things, hereinafter referred to as "collective goods", that is aimed at the sharing of work or use by the group of persons or the cooperative's members:
      1. income and savings deriving from the cooperative members' work,
      2. shared building for housing,
      3. joint land for farming, grazing, and gathering,
      4. facilities necessary or helpful for shared work or use by cooperative members, and
      5. means and instruments of collective work;

  3. Distinguishes "personal ownership" and "collective ownership" from "private ownership" in that the latter is the ownership of things, including those things listed in Art. 2, which is aimed at making profit from the exploitation of other persons' work;

  4. Requires Member Nations to recognize and guarantee personal ownership and collective ownership;

  5. MandatesMember Nations to prescribe with local laws the ways personal ownership and collective ownership are:
    1. acquired, in particular regulating the cases of
      1. receiving things upon the death of a person (inheritance),
      2. taking possession of nobody's or abandoned things (occupation),
      3. finding lost things (invention),
      4. adding value or materials to other's things (accession),
      5. separable mixing of different owners' things (union),
      6. non-separable mixing of different owners' things (commixtion),
      7. formation of a new thing from other's things (specification), and
      8. possession for a certain period of time of other's things (usucaption),

    2. enjoyed, in particular
      1. prohibiting speculation and sharecropping on personal goods and collective goods, and
      2. legislating on selling, renting, and mortgaging of personal goods and collective goods, and

    3. limited, in particular determining the unlawful use of personal goods and collective goods to harm or harass others;

  6. ObligesMember Nations to ensure in the implementation of the provisions of Art. 5:
    1. the social function of personal goods and collective goods,
    2. the right to obtain personal goods in a fair and unhindered manner to everyone, and
    3. the collaboration of workers and users in the management of collective goods;

  7. AllowsMember Nations to:
    1. determine appropriate planning and controls to direct and coordinate economic activity for social objectives,
    2. promote and encourage personal and collective ownerships through the appropriate means,
    3. secure the character and purposes of personal and collective ownerships through appropriate controls,
    4. reserve or transfer buildings, lands or facilities to communities of workers or users, and
    5. expropriate personal dwelling houses and small cultivations for reasons of the public weal in such cases provided for by local law and with provisions for compensation.

  8. Clarifies that the provisions of this resolution do not affect other forms of ownership recognized by Member Nations besides personal and collective ownerships.

Present. Genuinely not sure how to feel about this, and this should have been submitted under its actual title, not just an abbreviation thereof. It's not like the title exceeds the cap for proposal titles (and the author submitted under the original title previously).

Against as per MoWAA discord discussions. To quote:

"To be honest I find the current resolution to be quite awkward because this is the second time that this participant has submitted a resolution on a similar topic and it does not appear to me to be the case that the user has a particularly good understanding of this topic either from a common law or a civil law perspective."
