Nubt II For Justice: Conservation

Good Morning, TNPers!

First of all, I'll start by introducing myself, my name is @Nubt II of Mortipal, shortened to Nubt II as not to make it a tongue-twister. I am the Founder and Chairman of The North Pacifican Socialist Party, a Resident-Awaiting-Citizenship of Lazarus, RA Representative, and occasionally a resident of The Leftist Assembly; however most of you (if you know me) know me as Nubt II, nosy journalist, and CEO/Chairman/Founder of The North Pacific Today, which has grown immensely the last couple of months from a barely-known service only on the RMB, to a regionwide-known forum-covered, viral, and official news service with 2,000 views. More importantly, however, and like all of you, I am a proud North Pacifican, with full devotion to the North Pacifican community, as I am a Executive Member of the Culture, Cards, and (formerly/awaiting approval) Home Affairs Ministries. I am also a former member of the Communications, Radio, and Foreign Affairs Ministries.

Okay, so my motto might be a little weird. Usually when people see a socialist guy, who's running for an office, "conservation" isn't the motto they expect. I chose conservation as my cornerstone and head belief for this campaign because of lots of things. First of all, I would like to point out that I will not add any radical changes or expansions to the court. Secondly, I would like to point out that one day -- just like anywhere --, it's a nature of time that the old ways will come in sin. I am just not the person to destroy the court with new beliefs. Lastly, I would like to point out the great work of the previous and current Justices, who have always did their best to innovate, improve, and conserve the court, and they did a good job at it. I'm not opposing any of them.

However, all of you must be like: Who is this guy, what does he want, and why is he running?

Well, I'll be answering all these questions accordingly:

  • Why am I running?
For the memes. I'm kidding. I'm running because of a lot of things. First of all, I am running for Justice because of my feelings of self-service to TNP, and my willing to serve. Secondly, if elected, I would promise to do what previous Justices have done -- but better -- and this doesn't mean that the current or previous Justices are bad, or have not done these things, it just means that if elected I will keep these qualities, not add them, because they are already there, which again, promotes my "Conservation" motto. So, here are my "things I'll keep":
  • However tempting or dangerous it may be, I will promise to contaminate, or regulate (not grow, but not decrease) the court's powers, and will work to hear -- and not interfere, nor decrease -- the Regional Assembly's powers.
  • I will also not -- again -- no matter the temptations or dangers, judge a defendant based on fraudulent, biased, or opinions, nor will I accept any form of bribes.
  • If elected, I wouldn't vote on any RA proposals, and would only vote "Present". This is because of my belief of the court's independence, and splitting "politics", or the legislative branch, from the Judicial system.
  • I will continue the tradition of a professional and timely court, with sound judgement. No extra radical changes.
Apart from the obvious stuff above, let's stick with the important question that is frequently asked:

What is my experience with North Pacifican law?


  • Well, not much, I am not a law nerd, but I have my own experience with North Pacifican law. I have -- while being away from The North Pacific -- quietly studied and experimented with North Pacifican law. So, as I am not a law genius, if elected, I will be able to judge accordingly based on the correct laws and clauses, meaning that I am not a expert, but not completely unknowledgeable of North Pacifican law at the same time.
And so, I am asking for your vote for Justice in the most honorable Court of The North Pacific.

1. Let's say your goal is to transform the Court into a cesspit of conspiratorial slime sitting atop a minefield of segregated political alliances and treason without getting thrown out office before the term is up. How would you do it?

2. The Delegate appoints and the RA confirms a Justice to prosecute another Justice for Gross Misconduct. Is that permissible? That prosecuting Justice then keeps calling for votes on recusing the Temporary Hearing Officer appointed to replace that Justice. Would the Court need to hold a vote every time one is requested? Who would participate in such a vote? Cite evidence from the Constibillicode.

3. Any changes to the Constibillicode you'd like to see? Doesn't have to be specifically related to the Court.

I don’t see how voting on legislation and RA motions in any way violates judicial independence.
 
It's been a while since anyone asked this question:

How would you use the power of the Justice's seat to seize power for yourself within the region?

On other part, is is visible that the way the law works in the region is a conjunction of civil / continental law, per we have a codification of laws, but it also has a basis of common / anglosaxon law, per the bases of the extent of the law, its interpretation and how they can be executed are relying on previous rulings from the court.

Which of these two schools of law would you say has more influence over the region's legal system?


You've said you have studied and experimented with the laws of the region, but I will remark that the previous rulings of the region also have importance. Have you studied off those as well? If so, could you comment your oppinion on any of the rulings put out by the court?
 
Bro, why would we elect you? You’re literally so incompetent that you didn’t realize that publishing a news article like the one you did would constitute espionage.

You want to be one of the people responsible for interpreting and applying the law while being indicted yourself? Hard pass.
 
Anyways you might have the odds against you considering that you’re heading to court accused of espionage. I already understand that it was a mistake because you probably lacked the knowledge that it is espionage to reveal information from the private halls. I hope this isn’t the end of TNP Today but that in the future you make sure that you don’t release classified information. Here’s my question: Why should I vote for you even though you’re being accused of espionage?

What espionage? I literally found information almost anyone could see, why and how would I even use spies? Where did you find information that I'll be charged with espionage (not saying I'm not being charged, just asking), anyways? Could you also tell me the article supposedly being charged? I'd also like to point out that if I'm charged with espionage, The North Pacific Today would shut down. How would I have the courage to continue a service (or even stay in a region) that I've committed a crime in? Lastly, how is a innocent mistake considered incompetent. I just realized that the "Private Halls" forum tab is supposed to not be revealed information from. I appreciate your comments however.

Well, it doesn't really violate judicial independence, it just shows the wrong impression of a politically-sided justice. Which I don't want, nor believe in.
You can’t vote Present in legislative votes. It’s either Aye, Nay or Abstain.

Why should we trust someone whom is being openly accused of espionage to be our justice?
Posting any form of private information publicly is generally a bad idea.
Again, I had no clue that this was even partially-classified information. And again, why did I not even get any official charges nor even a message from a non-official warning me or even informing me of these charges (besides when I decide to run for Justice)?

Well, even if these charges are official and genuine, I'd like to point out that many modern leaders have been prosecuted for a crime before, with all due respect to these persons (Madjack, Bobberino, Territorio Di Nessuno, Prydania, 9003, etc.). However, if prosecuted successfully, I will probably shut down all companies I own, and possibly permanently leave TNP.

With all due respect, given that there is documented evidence that you personally published private information before it was made official, which is a crime, I'd say it's official and genuine, I'd also like to point out that as far as I know all the people you have listed were not running for election during their prosecutions, you are.
Potentially being prosecuted for a crime which you did not know was a crime doesn't help your case in being fit to be Justice, you have alot of enthusiasm and I hope you continue ventures elsewhere in TNP but for now, you're not ready.

Unfortunately, this is no longer an option. The last thing I expected is to be charged with a crime in my home region. I am considering my options, and it would be likely if I renounce my citizenship soon. Thanks, however.
The best thing you can do right now is to go through the process, and find competent counsel that can defend you. Even if they fail to acquit you, they can try getting a lesser sentence for you. And renouncing citizenship isn't going to make the charges go away; that'll just delay the implementation of sentencing if you are convicted. Plus, read the legal code, look at what it says about what you can be sentenced to if you are convicted: "3. Espionage will be punished by the suspension of speech and/or voting rights for whatever finite duration the Court sees fit." It's not going to result in a ban. You might just have to sit out of voting in an election or two.

Even St. George (MadJack) bounced back from criminal charges in 2019 to become Delegate today, so this is not hopeless.

I am utterly appalled at what I'm seeing from The North Pacific. Not because someone facing an espionage charge is running for a Court Justice position, but that our community is causing Nubt II to feel unwelcome.

Personally, Nubt II may be bringing a lot of stuff to the table, but at least they're actually putting in an effort. And besides subtly hinting at possible espionage, did anyone actually reach out and warn them of it?

It is with this that I formally offer my services to serve as Defense Counsel of Nubt II when the Court take up the case of espionage against them.

Personally, Nubt II may be bringing a lot of stuff to the table, but at least they're actually putting in an effort. And besides subtly hinting at possible espionage, did anyone actually reach out and warn them of it?
