General Assembly Resolution #371 “Toxic Heavy Metals Act” (Category: Environmental; Industry Affected: All Businesses - Strong) shall be struck out and rendered null and void.

The World Assembly,

Noting the good intent of the Toxic Heavy Metals Act which aims to sensibly limit the use of toxic heavy metals,

Understanding that the definition of "Toxic Heavy Metals" is incredibly broad and problematic as the resolution does not require that toxic heavy metals actually be toxic, only "potentially toxic" (which may apply to far more metals than is intended), reasonably dense and noted as such by the World Assembly Scientific Programme,

Realizing that such an incredibly broad definition does the following:
  • bans member states from discharging these metals into the "natural environment," (which again, applies to more metals than intended),
  • forces member states to waste valuable resources and funding researching alternatives to the use of all these toxic heavy metals, which as noted above can include harmless metals and,
  • needlessly regulates the use of harmless metals,
Recognizing that the language used to actually reduce the use of toxic heavy metals is extremely weak, as the only mandate related to use requires member states "phase out the use of toxic heavy metals and their compounds" without any further elaboration which allows for extremely slow and negligible reduction of the use of toxic heavy metals,

Confused by the exemption of military use of toxic heavy metals, as military use is just as damaging to the environment as civilian use, when such use is actually damaging, and such an exemption also makes way for loopholes in the form of otherwise illegal disposal of toxic heavy metals in the name of military use,

Hereby repeals GA#371, the Toxic Heavy Metals Act.

Repeal "Toxic Heavy Metals Act" was passed 12,506 votes to 1,060 (92.2% support).

Overview
"Repeal 'Toxic Heavy Metals Act'" seeks to repeal GA 371, a resolution that aimed to combat pollution associated with toxic heavy metals. This repeal argues that GA 371 has an overly broad definition of what constitutes a "toxic heavy metal" with severe unintended consequences for industry and development, while also being ineffectual at actually mitigating toxic heavy metal pollution. In addition, the repeal criticizes the target's exemption for military uses as running counter to the spirit of the legislation.

Recommendation
This repeal makes excellent points concerning the target resolution. In particular, the potential range of interpretation as to what constitutes a "toxic heavy metal" is broad and does not actually require that the substances in question be toxic. Furthermore, the Ministry finds itself in agreement with the repeal in regards to the potential adverse effects of such a broad definition, as well as in regards to the ineffectiveness of the target resolution towards achieving its desired goal. Lastly, the Ministry finds that the exemption for military purposes handicaps the legislation severely.

For these reasons, the Ministry of World Assembly Affairs recommends voting For the at-vote General Assembly proposal, "Repeal 'Toxic Heavy Metals Act'".

It should be noted that IA has filed a challenge against this proposal- but not for the reasons you may expect.

Jedinsto and IA both agreed before submission that this challenge would be filed. The goal is to force a GenSec precedent via ruling on committees- are they under the "perfect committee" rule, or the "reasonable nation" rule? If GenSec upholds the former rule, this proposal is legal. If it isn't, then it is illegal.

On further internal discussion, re-opened. Should GenSec concur with Sep’s challenge, will go back to locked, etc.
 
I have unlocked this thread as this proposal has been resubmitted. The necessary changes were made by the author to ensure its legality this time around, and these changes have been reflected in the OP.
 
As of 6:50 PM EDT, this proposal has reached quorum, and will be voted on during the next Major Update (I don't know when that is).
