[Private] Criminal Charge - TNP v Dakota Sioux

An indictment purporting to charge Dakota Sioux with libel has been filed.

As I have indicated in Discord, I am minded to reject the indictment as the crime it charges is not known to our criminal law and only crimes in the Criminal Code may be charged.

Rejection of Indictment

The indictment purports to charge Dakota Sioux with the crime of libel. No such crime is set out in the criminal code. The Bill of Rights, in article 6, provides that “No Nation shall be held to answer for a crime in a manner not prescribed by the Constitution or the Legal Code.” The Legal Code, Chapter 1, clause 1 provides “No criminal case may be brought before the Court of the North Pacific against any resident for any crime not listed in the Criminal Code.” These prohibitions prevent the Court from accepting the indictment and it must be rejected.

For those reasons, the Court rejects the request for indictment filed by Filiposgov concerning Dakota Sioux. The request may be resubmitted only if significant changes have been made to address these reasons.
