I'm Funkadelia, and I decided to run for TNP Court Justice during this election. I previously held the position August through November 2012. I was also a Court Justice from July through September of 2013. I have been a member of TNP since June of 2012, with a brief lapse in 2014. I seek to be productive and helpful not only in TNP in general, but similarly if I were to be elected as Associate Justice of the Court. As I said, I have experience at doing this, and during my service alongside Blue Wolf II and Hilevile, the court was swifty and mostly non-controversial, and I believe my term as Justice was, for the most part, a success. Similarly, there were no major problems or hold ups during my period serving with r3naissanc3r or Romanoffia, other than the Attorney General at the time being inactive. I would be competent in this position and I will be able to help in delivering timely decisions to matters brought before the Court, as I have done in my previous term. I am also confident that my decisions will be readable and make sense, so that it is as easy as possible for all citizens of The North Pacific to understand their laws and how they work.

Of the court's decisions within, say, the last year or so, which do you most disagree with and why?

What changes, if any, do you think would improve the Adopted Court Rules?

The ruling within the past year I most disagree with was the ruling tendered on May 18th, 2014, with respect to the accountability of the Security Council under the Freedom of Information act. While I can understand the ruling and the arguments for it as they are, I disagree that the Security Council should be exempt from the Freedom of Information Act because they are not technically part of the executive. Consider the three following lines of the FoIA:
17. The Delegate and appointed government officials will be delegated the task of informing the Assembly of any governmental action not already disclosed by the respective officers of the Executive.
18. All registered residents residing in The North Pacific may request information from the Government through the Delegate and the designated officers of the Executive.
19. The Delegate and the designated officers of the Executive will endeavour to retrieve information requested from the different departments of the government, who are obligated to release this information provided it will not and/or does not present a threat to regional security or unduly impinge on the privacy of private residents

These lines make it clear that the intention of this law was to hold the government accountable to the citizens. Without it, the government, whether it is the executive or the Security Council, would be able to make secretive decisions away from the eyes of the public, to whom they are committed to serve.

Constitutionally, Security Council members are considered government officials:

2. Government officials are the constitutionally-mandated elected officials, any officials appointed by them as permitted by law, and members of the Security Council.
The way the Freedom of Information Act is written, it is my opinion that the Security Council, as government officials, are obligated have the oversight of the Freedom of Information Act. Since the law requires that the executive must "endeavour to retrieve information requested," that would mean that the executive would either extract the information requested from the Security Council, or direct them to divulge the information. As it states later in the same clause, "who are obligated to release this information," meaning that if the Delegate or the executive demands the information from the Security Council, they are legally obligated to release it under penalty of law.


What changes, if any, do you think would improve the Adopted Court Rules?
While many people complain about the complexity of Court Rules and how long trials typically take, I agree with how the Court Rules are currently structured and would make no effort to change them.
