Membership Administration Amendment Bill

Mr Speaker could you delay putting this to a vote until the Delegate has responded to the WA Act. We will need to change the renumbering depending on what he does.
 
If the delegate has not responded by the end of formal debate, I will schedule the vote to begin after he has done so (or the legislation has gone into effect). If that becomes necessary, I will allow the renumbering clause to be fixed, but will not extend formal debate, or allow substantive changes to the bill.

Formal debate ended on this proposal on August 31. My apologies for not scheduling a vote then; this slipped through the cracks somehow. It will go to vote presently.
 
Applications may be subject to evaluation by the Vice Delegate within three days of their submission.

I believe the change from 'will' to 'may' means that some RA apps could be evaluated and some not. If that is so, that does not appear to be in conformity without our equal protection clause on the Bill of Rights (clause 9). What would a VD's excuse be if he/she didn't evaluate someone but does take the time to evaluate someone else?

"Oh, I didn't have the time?"

Not sure if that will be an argument that is accepted by the court. I'm quite disappointed in TNP at present voting to support this bill. This is a fundamental shift away TNP has done business for years and, imo, a bright spot for us leaves with the passage of this bill.
 
I agree. I am confident that it will not stand up to a challenge on Constitutional grounds, and the Court will have to strike it down.

I'm not sure what text you're responding to, Punk, but it isn't in the bill...

5. Forum administration will have 14 days to evaluate Regional Assembly applicants and verify that they are not using a proxy or evading a judicially-imposed penalty. The Vice Delegate will have 3 days to evaluate Regional Assembly applicants and verify that they do not pose a threat to regional security.
