I have a problem with this. For how long is the office considered vacant? I ask because when the Vice Delegate is acting Delegate he vacates his office temporarily too. It seems a little over the top for the offices of Delegate and Vice Delegate to be legally considered vacant just to appoint a THO.
It probably could be made clearer, but what it means is the position is treated as vacant in the implementation of the clause not vacant in general.

I know what it means and I'm not convinced that it does since the Security Council law says in "any period" in which the Vice Delegate is acting Delegate, the office of Vice Delegate is vacant.

The period in which this clause would be implemented is still a period - I'd also remind people that finding THOs can often take ~24 hours, it's not a split second thing.
 
It's not a period... it's a narrowly defined scenario.

It's treated as vacant, not actually becomes vacant.

I agree it's slightly awkward in the wording, but I think it is the realistic interpretation.
