[CRIMINAL] Compaint on the Election Commission (Eluvatar, Hileville, LordRavenclaw)

Name of Complainant: TNPCLU (The North Pacific Civil Liberties Union)

Name(s) of Accused: Eluvatar, Hileville, Lord Ravenclaw

Date(s) of Alleged Offense(s): Continuous, 11 May 2013 - Present

Specific Offense(s): Election Fraud by ways of not allowing Romanoffia onto the ballot.

Relevant Excerpts from Legal Code or other Laws:
Section 1.3: Fraud:
8. "Election fraud" is defined as the willful deception of citizens with regards to the candidates running, the time and venue of the elections, or the requirements and methods by which one may be eligible to vote or run for office

Summary of Events (What happened, in your own words): Romanoffia, despite clearly declaring his candidacy for Vice Delegate, was not listed on the ballot.

Evidentiary Submissions:Election thread, Romanoffia's Campaign Thread, General Election Thread

Comments: The Election Commission (EC) claims that the rule that they have created is that nominations must be posted on the thread named "May 2013 General Election." However, there is absolutely no rule stated anywhere that requires this. They have willfully committed election fraud by continuing to disallow him on the ballot.

Even if it were the policy of this office to respond to complaints in whatever order it desires, the criminal system is not built for quick judgments. It is built to find the truth. This office will investigate this complaint, and file charges as appropriate. Any evidence you, or any other citizen, is able to provide will be appreciated.

The following log is also evidence of the accused acknowledging the fact a mistake was made, yet not rectifying the mistake:

19:38:07) Eluvatar: theres also no law that you have to vote in a particular place
(19:38:20) Funkadelia: EXACTLY.
(19:38:26) COE: Now, I still think that Roman is a candidate by legal definition
(19:38:37) Funkadelia: So in every way, shape, and/or form the EC is absolutely wrong
(19:38:45) Funkadelia: I don't even care if the recall gets moved at all
(19:38:53) Funkadelia: Because I blame the Court and the EC
(19:38:55) Eluvatar: that, that the guidance was not repeated, was a mistake

From a legal theory standpoint, the fact that a person fixed a wrong done by a criminal offence does not necessarily mean they are not still guilty. If, for example, I broke into your house and stole your TV, but then brought it back, I'd still be guilty of theft. It's the act, not the result, at least in theory.

But theory sucks. In practice, you've withdrawn your complaint and I see no reason to pursue it independently. This matter is closed.
