FD - Term Limits Amend

Article III
Section 3: Term Limitations.

1) No person, through one or more Nations, who has acted in any Cabinet-level position as Delegate, as Prime Minister, or as a particular Cabinet Minister, for more than one half of a term to which some other person was originally elected, shall be subsequently elected to that elected office of the Cabinet more than once, pursuant to this section.
2)
1) No person, through one or more Nations, may be a member of the Cabinet, in any position, for more than two consecutive terms.
3) No person, through one or more Nations, may hold any Cabinet-level position for more than two terms within a one year period.
4) No person, through one or more Nations, may hold any Cabinet-level position for more than four terms (consecutive or otherwise) over a two year period.
5)
2) For purposes of this section, service by a person, through one or more Nations, in a Cabinet-level position for more than one half of a term to which some other person was originally elected or appointed, shall be treated as a complete term in that office.
6)
3) For purposes of this Constitution, "Cabinet-level position" is construed to refer to the UN Delegate for the Region, any UN Vice Delegate who has acted as UN Delegate for the Region for more than half of an elected term of office, the Prime Minister, any Cabinet Minister of the Regional Government, any deputy Cabinet Minister who has acted as a Minister for more than half of an elected term of office, or the Attorney General.

1) No person, through one or more Nations, may be a member of the Cabinet, in any position, for more than two consecutive terms.

As worded, this language could be argued to not apply to the Delegate.
Since "cabinet-level position" is defined in the section, use of that phrase would be strongly preferable and would keep the usage consistent.

I believe that the wording is workable. Term limits are a great idea.

Including delegates is also a good suggestion.

Ik

:bat:

Grosse - part 6 of the section pretty well covers that. (Unless we're taking that out.)
Yes, if you take Gross' suggestions and change the wording of the amendment to "Cabinet-Level Position", part (formerly) 6 does cover the Delegate.

;)

Changed to "cabinet level position", the amendment has my support. It cuts down on the volume of the article and simplifies it to a minimum volume with a maximum of content. Very good!

How did it go to vote without the change that was previously agreed upon? I note that our esteemed speaker singled out an RA member, and unfairly blamed that member for killing the vote. If the corrected proposal had been posted in the first place, we wouldn't be back in discussions, would we?

7 more days for nitpicking (or more like ignoring then bringing it up during a vote) and I'll put back to a vote.

Also it erases the definition for what a term is, like if I was re-elected then quit the day after does that count towards term limits (if I wasn't a speaker) if not then how about one week in office? Two weeks? And you get the point.

I don't believe it does. If you're refering to the removal of 1), to my way of looking at it it seems somewhat unnecessary as 2) -originally 5)- along with the term limits covers this. The only thing that isn't mentioned here (and wasn't anyway) is what you say about. I'm unsure if thats because it is mentioned elsewhere.

The way to keep straight what term limitations apply to is this:

The primary limit is being "elected" to a "Cabinet-Level position". The clause on "a majority of the term to which some other person was elected or appointed deals with circumstances where a vacancy occurs during the first half of an elected term.

So it is implicit that regardless of how long you serve the term, if you were originally elected to the position then it counts as a whole term. I follow you now.
