Delegate Directives


This thread functions as a collection of the new Delegate Directives issued by Delegate @Halsoni and his duly elected successors. The old Delegate Directive thread was archived upon the issuance of the Executive Authority and Governance Directive.

Executive Authority and Governance


Preamble


The Delegate is the constitutionally established chief executive officer of The North Pacific and bears ultimate responsibility for the governance and administration of the region.

To ensure continuity in executive governance, this Directive establishes the primary doctrine governing the interpretation and exercise of all Delegate Directives, executive bodies, and delegated authorities.

It is therefore by the authority vested in me as Delegate, by the Constitution and Legal Code of The North Pacific, that I direct the following:

Article I: Delegate Supremacy


  1. The Delegate is the supreme and final executive authority of The North Pacific.
  2. All executive power not expressly limited by the Constitution or the Legal Code is vested solely in the Delegate.
  3. Executive authority flows from the Delegate and may be exercised by others only by delegation. Such delegation does not confer independent, inherent, or co-equal authority upon any executive office, council, programme, or official.

Article II: Procedures of Delegate Directives


  1. Delegate Directives are binding executive instruments issued in the exercise of the Delegate’s executive authority.
  2. Delegate Directives have immediate force and effect upon issuance unless explicitly provided otherwise within the Directive.
  3. In the event of conflict between Delegate Directives, the most recently issued Directive shall take precedence, unless the Delegate expressly directs otherwise.
  4. No Delegate Directive shall be interpreted as limiting the Delegate’s authority beyond its explicit terms.

Article III: Delegation of Authority


  1. All executive authority exercised by any person or body other than the Delegate is delegated authority and exists solely at the pleasure of the Delegate.
  2. The Delegate may delegate, condition, limit, suspend, or revoke any executive authority at any time, with or without cause, and with or without prior notice, except where expressly prohibited by law.
  3. Delegation of authority does not confer any right, entitlement, tenure, or expectation of continued authority.
  4. No delegation of authority shall be interpreted as a transfer, sharing, or dilution of the Delegate’s executive power or discretion.

Article IV: Advisory Institutions


  1. Advisory institutions, such as internal votes, committees or the Executive Office as established by the Delegate, exist to inform the Delegate or execute the Delegate’s agenda, and do not bind the Delegate.
  2. Advisory institutions possess no binding authority and may not delay, condition, or constrain the exercise of executive authority by the Delegate.
  3. The Delegate is not required to solicit advice from, adhere to, or justify deviation from any advisory institution unless expressly required by law.
  4. The absence of consultation, or departure from advice given, shall not invalidate, delay, or otherwise affect any executive action.

Article V: Interpretation


  1. The leading interpretation of all Delegate Directives rests solely with the Delegate.
  2. Delegate Directives shall be interpreted in a manner that maximises executive effectiveness and continuity.
  3. No provision of a Delegate Directive shall be interpreted as limiting the authority of the Delegate except where such limitation is expressly stated.
  4. Omission or ambiguity within a Delegate Directive shall not be construed as a restriction on the Delegate’s authority.
  5. Past custom, precedent, or practice shall have no binding or interpretive force unless expressly affirmed by the Delegate.

Article VI: Overruling Powers


  1. The Delegate may overrule, suspend, or set aside any Delegate Directive, in whole or in part, at their discretion.
  2. The Delegate will endeavour to inform the public when they exercise their authority to overrule, suspend, or set aside any Delegate Directive, in whole or in part.
  3. No justification or explanation shall be required for the exercise of this authority.
  4. Any such action shall have immediate force and shall remain in effect until altered or rescinded by the Delegate.

Article VII: Acting Delegacy


  1. In the event that an Acting Delegate assumes the functions of the Delegacy, such authority is exercised solely for the purpose of maintaining continuity of governance during the Delegate’s absence, and the Acting Delegate will execute the agenda set forth by the Delegate to the best of their ability.
  2. The Delegate will endeavour, whenever possible, to issue a list of commands to the Acting Delegate prior to taking a leave of absence, which the Acting Delegate will execute to the best of their ability.
  3. The Delegate retains the right to be consulted on significant action taken by the Acting Delegate that was not explicitly authorised by the Delegate before taking their leave of absence.
  4. No Acting Delegate may undertake irreversible, structural, or long-term actions without the explicit prior authorisation of the Delegate, unless an urgent situation calls for immediate and decisive action.
  5. All actions taken by an Acting Delegate remain subject to review, modification, or revocation by the Delegate upon the conclusion of the declared absence.

Article VIII: Revocation and Amendment


  1. Any Delegate Directive may be amended or repealed by the Delegate at any time without justification, reasoning or public statement.
  2. The Delegate will endeavour to inform the public when they exercise their authority to amend or repeal any Delegate Directive.
  3. All existing Delegate Directives shall be interpreted in accordance with this Directive.
  4. The issuance of this Delegate Directive declares all Delegate Directives issued prior to this document null and void.

Delegate Directive No. 2

Modern Gameplay Compact Sanctions


Preamble

The North Pacific is a signatory to sanctions implemented by the members of the Modern Gameplay Compact, of which The North Pacific is a member and obligated by treaty with the other signatories to take collective action in response to acts of aggression made against our regions. In accordance with the ruling of the Court of The North Pacific, the Delegate is unable to apply clause (a) of the first section of the sanctions to any resident of The North Pacific who is simultaneously a member of the sanctioned organisations.

It is therefore by the authority vested in me as Delegate, by the Constitution and Legal Code of The North Pacific, that I direct the following:

The following regions/organisations are hereby sanctioned: The Brotherhood of Malice, The Black Hawks, The Communist Bloc, Sparkalia, Osiris and all regions which:
i. Constitute their territories or possessions;
ii. Are operated by their members and contribute to their military or support their cause;
iii. Have a treaty with them;
iv. Constitute the territories or possessions of regions mentioned in items ii or iii.

Members of the sanctioned regions/organisations are prohibited from:
a. participating in any events hosted by the signatory regions/organisations;
b. being members of coalitions, factions, etc., led by the signatory regions/organisations in NS events;
c. being included in/platformed by media or promotional events/endeavours produced by the signatory regions/organisations;
d. serving in a leading/command role in joint military operations hosted by the signatory regions/organisations

The signatory regions/organisations are prohibited from:
a. participating in any events hosted by members of the sanctioned regions/organisations or in any events hosted by regions/organisations in which members of the sanctioned region/organisations participate;
b. participating in coalitions/factions/etc led by members of the sanctioned regions/organisations or in which members of the sanctioned regions/organisations participate;
c. participating in any media or promotional events/endeavours produced by members of the sanctioned regions/organisations or in which members of the sanctioned regions/organisations are included/platformed;
d. participating in military operations hosted/led by members of the sanctioned regions/organisations, provided those operations are not exclusively anti-fascist in nature.

The signatory regions/organisations will:
a. oppose and vote against World Assembly resolutions authored or co-authored by members of the sanctioned regions/organisations;
b. support and vote for resolutions repealing resolutions authored or co-authored by members of the sanctioned regions/organisations (but may use discretion if the author or co-author of such a resolution is impacted by sanction a. or abstain if the author or co-author is at war with the signatory);
c. oppose and vote against World Assembly resolutions nominating members of the sanctioned regions/organisations for commendation/condemnation;
d. support and vote for resolutions repealing resolutions nominating members of the sanctioned regions/organisations for commendation/condemnation (but may use discretion if the author or co-author of such a resolution is impacted by sanction a. or abstain if the author or co-author is at war with the signatory);
e. support and vote for resolutions liberating regions occupied by members of the sanctioned regions/organisations (but may use discretion if the author or co-author of such a resolution is impacted by sanction a. or abstain if the author or co-author is at war with the signatory).

Delegate Directive No. 3

World Assembly Policy


Preamble

The vote of the Delegate of The North Pacific is the largest in the world and must be used responsibly.

To provide the World Assembly residents of The North Pacific an opportunity to exercise their free speech and hold the government accountable for its position in the World Assembly, this Delegate Directive establishes a process to achieve this while encouraging our democratic values.

It is therefore by the authority vested in me as Delegate, by the Constitution and Legal Code of The North Pacific, that I direct the following:

Article I: Internal voting

  1. The internal vote is intended to advise the Delegate on their voting policy, but does not hold binding authority over the Delegate’s vote.
  2. The Ministry responsible for the Delegate’s World Assembly policy shall make forum-based voting threads on every resolution that is either at vote, in queue or nearing quorum.
  3. By order of the Delegate, the Minister responsible for the Delegate's World Assembly policy may establish a classified vote for the Executive Council to replace the corresponding internal vote.
  4. People who are neither a resident of The North Pacific nor the author of the resolution that is being discussed in the voting thread are asked to refrain from participating in the discussion.
  5. Eligible voters are residents with a World Assembly nation in TNP and/or NPA personnel. Voters who do not satisfy these requirements are asked to refrain from voting and are required to announce their non-eligibility by adding a “[Non-WA]” tag to their vote.
  6. Voting will exclusively occur in an internal forum thread or a classified space. External voting methods will not be taken into consideration when advising the Delegate’s vote in the World Assembly.
Article II: Delegate’s vote

  1. The Delegate retains the discretion to choose their voting position in the World Assembly, independent of the outcomes of the internal forum vote, thereby exercising complete autonomy in their decision-making process.
  2. The Delegate will endeavour to vote in the World Assembly per the majority’s wishes in the internal vote whenever possible.
  3. In instances where the in-game World Assembly Delegate (WAD) differs from the Serving Delegate (SD), the WAD must adhere to any command issued by the SD concerning the WAD's voting position in the World Assembly.
  4. In instances where the Delegate veers away from the internal vote, they shall endeavour to post a statement in the voting thread explaining their reasoning.
  5. If the Delegate determines that the reasoning is classified, they are entitled to withhold a complete explanation by citing this section.

Delegate Directive No. 4

The Gameside Advocates


Preamble

The gameside community of The North Pacific is unmistakably part of the region's culture, and must be treated properly by the government authorities.

In an effort to create a cultural hub of lively conversation on the RMB, the Gameside Advocates will make sure that this goal is achieved while adhering to the standards of The North Pacific. They will be the primary government presence in the gameside community to signify unity between the different parts of our region.

It is therefore by the authority vested in me as Delegate, by the Constitution and Legal Code of The North Pacific, that I direct the following:

Article I: Organisation

  1. The Gameside Advocates are the primary liason of the Delegate and Minister of Integration to the Regional Message Board (RMB), and will be tasked with informing the gameside community of important news or events; with monitoring the RMB for violations of NS rules and community guidelines and report such activity to regional officers for response; and with organising and facilitating activities and other forms of engagement between members of the gameside and offsite communities.
  2. The Delegate will appoint a Lead Gameside Advocate to manage the Gameside Advocates and to determine who should be selected to serve as Gameside Advocates. The Delegate may also directly appoint Gameside Advocates.
  3. The Lead Gameside Advocate will announce all Gameside Advocate appointees and ensure that they take an oath of office, and will be appointed as a Regional Officer and empowered with suppression power on the RMB.
  4. The Delegate or Lead Gameside Advocate may appoint experienced Gameside Advocates as Senior Gameside Advocates who will be able to serve as a Regional Officer empowered with suppression power on the RMB.
  5. The Gameside Advocates will collaborate closely with the RP moderation team or will be designated by the RP moderation team to advise on RP guidelines and rules and to assist in their enforcement.
  6. The Gameside Advocate appointees should have experience posting on the RMB and should engage with the RMB regularly. The Lead Gameside Advocate will endeavour to appoint individuals who are active RMB posters and known members of the gameside community.
Article II: Guidelines

  1. The Gameside Advocates may propose and draft guidelines for managing the RMB and for moderating it, and present these to the Delegate for final approval and implementation.
  2. The RP moderation team will determine and advise on guidelines for RMB RP to be enforced by the Gameside Advocates.
  3. No rules or guidelines for RMB RP will be implemented or executed without consultation with the RP moderation team.
  4. Guidelines must be prominently displayed and easily accessible for the gameside community to review.
  5. The Delegate will enforce the RMB Guidelines when exercising suppression and Border Control powers.

Delegate Directive No. 5

Charter of The North Pacific Cards Guild


Preamble

Cards are an inherent part of North Pacifican culture, and the Cards Guild is famed for its excellence in the interregional cards community.

To make sure that the revival of the Cards Guild goes smoothly and that its standards are upheld, this Directive seeks to establish the baseline ruleset of the Guild and its operations.

It is therefore by the authority vested in me as Delegate, by the Constitution and Legal Code of The North Pacific, that I direct the following:

Article I: Establishment of the Guild

  1. The North Pacific Cards Guild (“the Cards Guild”, “the Guild”) has been established to promote activity in the trading cards community of NationStates, and instruct members of the region in how to develop their collections and explore various aspects of the trading cards community.
  2. The Cards Guild is subsidiary to the Ministry of Integration.
Article II: Leadership of the Guild

  1. The Guild is led by the Guildmaster, who oversees and is responsible for all of its activities.
  2. The Guildmaster is appointed and dismissed by the Delegate of The North Pacific, or their designated Executive Officer, at their discretion.
  3. The Guildmaster shall appoint members of the Cards Revival Committee and shall be the chair of the Cards Revival Committee.
  4. The Guildmaster must maintain citizenship in the North Pacific.
Article III: Guild Membership

  1. Guild membership is available to all residents of The North Pacific who have not otherwise been banned from the Guild.
  2. Guild membership will be managed and regulated by the Guildmaster.
  3. Each Guild member must designate a nation as their card-collecting nation.
  4. Guild membership is required to participate in non-executive card programs and exchanges.
  5. Guild regulations may be set by the Guildmaster and Cards Revival Committee as needed. Regulations may not supersede the Guild Charter.
Article IV: Cards Revival Committee

  1. The Cards Revival Committee is a group of like-minded citizens dedicated to supporting the Cards Guild and the North Pacific Cards Program.
  2. Committee members will be tasked with advising and collaborating with the Guildmaster for the benefit of the Cards Guild.
  3. Selected Committee members will be tasked with maintaining card farms for the purpose of supplying cards to the North Pacific Cards programs.
  4. Gifting requirements shall be set by the Committee with the consent of the Guild Master.
  5. Committee members shall vote on any new card program proposed by the Guildmaster or the Executive government. The vote shall be on the ability of the Card Guild to support the proposed program. The vote shall be non-binding on the Delegate.
Article V: Prohibited actions

  1. Guild members may not heist other Guild members’ card collecting nations, or The Northern Light nation. Heisting is defined as the act of attempting to sell a card to another Guild member’s puppet without that member’s permission, when the other Guild member is already attempting to sell said card to that puppet from their designated card-collecting nation.
  2. Guild members may report violations of this section to the Guildmaster.
  3. The Guildmaster will adjudicate any such reports and, if they determine that a violation has taken place, may remove a Guild member from the Guild, and ban them from membership for a period between one and six months.
