My understanding is that it has been clarified that the guidelines prohibit messages that consist only of emoji as spam. Even if it's a single emoji. But they do not prohibit use of emoji in messages that have text to them and are not otherwise prohibited.
More crucially, however, the RMB guidelines are not enforced through criminal trials. They are enforced through summary suppression, ejection, or bans, which are subject to judicial review.
Please stop posting this complaint.
