Hello TNP, my name is JhonsJoe, and I am running for attorney general.

Now, I've been Assistant AG for over 3 months, and I just recently got ranked up to deputy. I am knowledgeable of TNP judicial system and the job description of the AG , citing my experience in theese positions. Being the Attorney General, has been something I've always wanted to do.

Now first off, If I'm elected, I'd keep the current AG's attitude with anonymity of complainants. I think that residents should be able to submit anonymous complaints without fear. If I'm elected, I would also crack down on fake or forged evidence, including b: the use of the edit feature to change the text forum posts, the use of the "Inspect Element tool" etc...

And most importantly, I'd use a fair, even hand and consult with all members of my office before charging/not charging the accused.

I'd keep the criminals behind bars.
(In a metaphorical sense.)

At present there is proposed legislation before the Assembly that would enable a transition from an adversarial to a non-adversarial justice system.

1. As you understand it, what is the distinction between an adversarial and a non-adversarial justice system?
2. Of the two systems, which do you think is better suited for TNP?

1.In an adversarial system, the parties involved in a lawsuit would be responsible for evidence presented, equality between prosecution and defense is essential in an adversarial system.

2.I think an adversarial system is best for TNP, I would not support this legislation if it is brought to vote.

I have not noticed any announcement of this policy from the AG, and I think it bears scrutiny. Although I can understand the need for someone to tip off the AG's office anonymously, there is a difference between a narc and a complainant - and you specifically refer to complainants.

How would you reconcile this with the principle of a fair trial - allowing a defendant to face his or her accuser and question them in court? This is in real life enshrined in Roman law, English Common Law and the US Bill of Rights.

How will you preserve my right to an open and transparent legal trial, including my right to cross examine my accuser, if you are going to allow anonymous whisperings?

Can you give any instances of where this practice has come across the AG's desk, thus necessitating a "crack down"? You can usually only crack own on something that is actually happening.

I'd keep the criminals behind bars.

Is that what you see the point of the AG as being?

Since you asked this in a different manner within my thread, I feel I should address your comments here. Apologies to my opponent.

A Criminal Complaint and an indictment are not the same thing. Since you bring up RL institutions, I believe it is fairly common in most of those system for the initial complaint to be non-public. When a battered wife goes to the police to make a report against her husband, she doesn't make sure to take him with her. The investigatory/prosecutorial body then investigates the accusation to determine if formal charges will be filed. Once those charges are filed then the accuser is known.

Likewise, in TNP, if the AG's Office determines to press charges on behalf of the region, the accuser will be known to the accused. But, in order to avoid some of the undue harassment/asshattery that has occasionally taken place here in the past within public criminal complaints, a private means of beginning the 'investigation' stage is now an option.

This does not in any way impede anyone's right to an open and transparent legal trial, or impede any accused nation's right to cross examine the accuser during trial.

No, you are incorrect. I did not 'answer for him'. I provided an answer to you based upon the question you asked here, which is markedly different than the one you asked in my thread about the same issue.

My opponent stated that he planned to continue my policy, not that he planned to change it or modify it, therefore, my reasoning in having the policy to begin with is relevant to whatever answer he may choose to provide later.

While I do not wish to lose an election, I also do not wish anyone in my department to be ill-equipped with all avenues of reasoning that are available to provide answers to questions that some might think were designed solely to trick a candidate into backtracking on their campaign positions.
 
When JJ answers here he is answering as a candidate in the election, not as a current deputy or assistant. thus it was his answer I was interested in. As always with questions to candidates I was interested in the ability to answer and insights into character, not simply a factual answer to a procedural question. it is about sizing up the candidate.

Now the thread has been hijacked I see little opportunity for that to take place. I apologise to JJ for my part in continuing the threadjack. Perhaps election commissioners ought to split the thread at the point of GM's interruption?
