Q1: Necessity of the Attorney General

This is the first question of the debate for the election for Attorney General.




Do you think the Attorney General is a necessary part of the judicial system? If we did not have an AG's office what would be the next best way to handle the prosecution of criminal complaints?

I think that the Attorney General is a VERY necessary part of the judicial system.
If we didn't have it, prosecution of civil complaints would be left to sometimes untrustworthy private attorneys
 
I think the office of the AG is important to the judicial system; it allows for the Prosecution to be independent of the Court. If the office of the AG didn't exist, an impartial prosecution should appointed temporarily by an impartial office (such as the Delegate).
 
If I am honest, no, I do not believe the office of the Attorney General is a necessary part of the judicial system within TNP, outside of the caveat that it is legally mandated and therefore necessary in this regard. I believe nations bringing petitions before the Court could act on their own behalf and I believe the Delegate could appoint a Minister of Justice to act as the government liaison or advisor.

That said, since it is part of the legal system at present, then obviously it is necessary. Since the Delegate does not appoint a legal advisor for the government then the government should have the office of the AG present to act on its behalf. Likewise, under the current legal system, the office of the AG is tasked with keeping the legal structures in check. The office presents cases before the Court on behalf of all the nations of The North Pacific, not only those in the Regional Assembly or those that make petitions.
