DROPED

Name: International Political Asylum
Category: Human Rights
Strength: Significant

Alarmed by the stream of political asylum seekers to countries already burdened by their own affairs,

A political asylum seeker can be defined as one who seeks to escape their own country due to prosecutions brought against them, due to political tensions

Observing that asylum seekers are not currently protected within their own country,

Hoping that countries give all asylum seekers are given fair consideration and if denied are then given separate possible courses of action,

Believing in the right of every country to choose who shall be given asylum,

Concerned over the unregulated transnational movement of peoples seeking political asylum from within the boundaries of their native member state,

1.Encourages the creation of a “check-up” system, within the country itself, on those who have been already given asylum to confirm that they are able to peacefully and happily fit into society;

2.Mandates the create of a committee called the World Assembly Panel on Asylum Seeking (WAPAS) which assist political asylum seekers by:
a.Analyzing political asylum seekers so to find the country that would most benefit them;
b. If a conflict arises with the political asylum seeker then a meeting will be arranged focused upon the conflict with the political asylum seeker;
c.The refugee be provisioned to, if required , seek language training, cultural heritage classes and relevant socio-Eco political education to ease transition into host member state;
d.Ensure that all rights of the refugee are upheld during resettlement;

3. Requires the native nation, of the political asylum seeker, to:
a. Place the political asylum seeker into the custody of WAPAS, but the person(s) will still be held within the native nation;
b. While this political asylum seeker is within the custody of WAPAS, the situation in which the asylum seeker asked to be taken out of will be inspected
i. The purpose of this inspection would be to certify that the person(s) who seek asylum are actually being prosecuted due to political tensions;
c. Once the situation is analyzed, the WAPAS committee will decide weather or not the person(s) are being unjustly prosecuted;
i. If it is decided that the political asylum seeker is being unjustly prosecuted, WAPAS will require that the nation extradite the political asylum seeker into the custody of WAPAS outside of the native nation;
ii. If it is decided that the political asylum seeker is not being unjustly prosecuted he/she will be given back into the custody of the native nation;

4. Clause 2 and 3 shall only be evoked if the person(s) request the WA assistance for political asylum

Glad to see you coming to the ministry :)

Lets review:

Structurally this has a few issues:

A political asylum seeker can be defined as one who seeks to escape their own country due to prosecutions brought against them, due to political tensions

If you're attempting to define this, don't do it in your preamble, remember the structure, preamble, definitions, what it does. Try and keep everything in an order. Secondly, if you are defining it for the purposes of the resolution don't say it CAN be, because that leave it open to an optional interpretation, say IT IS.

Observing that asylum seekers are not currently protected within their own country,

I think that's something of a redundant and possibly false statement. I'd strike it altogether.

Hoping that countries give all asylum seekers are given fair consideration and if denied are then given separate possible courses of action,

I'm not sure I like this, it doesn't really do much for the draft. I would say something to the effect of "Seeking to ensure that asylum seekers are given fair consideration to their circumstances". Leave the last bit out, there's no onus on a country to provide an alternative solution, and w'ere still in the preamble here too.

Believing in the right of every country to choose who shall be given asylum,

Concerned over the unregulated transnational movement of peoples seeking political asylum from within the boundaries of their native member state,

These two could really be amalgamated and tidied up better. Perhaps "Believing in the right of every country to choose who shall be given asylum, yet concerned over the unregulated transnational movement of peoples seeking political asylum."

1.Encourages the creation of a “check-up” system, within the country itself, on those who have been already given asylum to confirm that they are able to peacefully and happily fit into society;

Ehm.... Clunky. Why are we checking on those who have been granted asylum after they've been granted it?

2.Mandates the create of a committee called the World Assembly Panel on Asylum Seeking (WAPAS) which assist political asylum seekers by:
a.Analyzing political asylum seekers so to find the country that would most benefit them;
b. If a conflict arises with the political asylum seeker then a meeting will be arranged focused upon the conflict with the political asylum seeker;
c.The refugee be provisioned to, if required , seek language training, cultural heritage classes and relevant socio-Eco political education to ease transition into host member state;
d.Ensure that all rights of the refugee are upheld during resettlement;

Couple of typographical errors,
  • Mandates the creation of the World Assembly Panel on Asylum, and tasks them with;
  • I'm not sure if A is practical, how would this work? They apply to WAPAS before they seek asylum and leave? Or? I think this needs clarification
  • Remember your language here, you've said which will assist (also, that needs edited, I see you've left a word out) asylum seekers by: But the language that follows after doesn't make sense as a complete sentence, ie:

    "assist political asylum seekers by If a conflict arises with the political asylum" see the issue? The sentence is broken, you need to tidy that up for most of that section.
  • C and D need tidying in line with the above, but they're not entirely unreasonable. I'd like to reevaluate them after it's been structured better so I can see exactly what you're aiming for.

This however, is a serious legality issue:
4. Clause 2 and 3 shall only be evoked if the person(s) request the WA assistance for political asylum

What you're saying here is, the mandates that this resolution has, are optional, and while I get your intent, if you remove clauses 2 and 3, what you have is only 1, which is an encouragement clause, and thus makes the whole act illegal. I'd either strike it, or revise it.

Lastly I've not looked at clause 3 yet because I think I've given you enough to work with at the moment, and hopefully some ideas that you can use on 3 before I look at it, HOWEVER, co-authorship on the GA side is limited to 1 nation, so you'll need to pick a sizeable acknowledgement nation if you want to keep it in, you can't acknowledge both.

Let me know when you've edited it, and I'll look again.
