Description: WA General Assembly Resolution #100: Anti-Cyberterrorism Act (Category: International Security; Strength: Mild) shall be struck out and rendered null and void.

Argument: The World Assembly,

Understanding that the "Anti-Cyberterrorism Act"(GA#100) seeks to limit acts of cyberterrorism,

Regretting, however, that the resolution defines cyberterrorism as "any premeditated, politically or ideologically motivated attack or threat thereof, through the use of information technology... by sub-national groups or agents,"

Knowing that the inclusion of the term "sub-national" was intended to limit the resolution's effects to the efforts of non-state actors, but also knowing that the term "sub-national" specifically refers to the administrative divisions of a national entity,

Bemoaning the fact that this definition limits the ability of nations to engage in cyber warfare,

Believing that cyber warfare may be used as an alternative to conventional warfare, and result in less loss of life than a conventional attack,

Accepting that even if the author's intent with regards to the term "sub-national" were to be respected, the resolution still severely limits the ability of nations to engage in cyber warfare and maintain plausible deniability of actions that may provoke conventional attacks as a response,

Cognizant that this resolution will continue to cause more harm than good as long as it remains in place,

Hereby repeals "Anti-Cyberterrorism Act"(GA#100).

MINISTERIAL REVIEW;

This one is a tough one, the repeal itself is well drafted, and the argument, well thought out. Although, in light of the strength of the resolution currently in place, it's hard when weighting them up to determine which comes off the stronger. The ministry's system has been what strength was retained by the original text, after the repeal arguments were made. In this case, the two seem deadlocked.

Regretting, however, that the resolution defines cyberterrorism as "any premeditated, politically or ideologically motivated attack or threat thereof, through the use of information technology... by sub-national groups or agents,"

The issue the author takes with this definition is the inclusion of the term sub-national, and while it is probable that the inclusion of this term may have subverted the target resolution, to have left it out would have created the same issue regardless, in truth, the definition of terrorism, in any right, has always been far too vague.

Bemoaning the fact that this definition limits the ability of nations to engage in cyber warfare

The Ministry fails to see why this would be so bad, essentially it limits a nations ability to conduct cyber terrorism, while ensuring it cannot be the recipient of it. The repeal author is almost making the argument that they want the shield and the sword here and are disappointed they only got the shield.

This is a clause we disagree with, the author shouldn't be making the statement that if it "were to be respected" when one considers the good faith requirement, lets assume it IS being respected, the repeal author takes issue then with the inability to avoid accountability for actions caused during warfare, an argument we cannot support.

MINISTERIAL SUGGESTION

Considering the arguments against, and the strength of the initial text, we are torn on this matter, the initial proposal serves in our opinion a strong proposal, even when weighted against the arguments presented by the repeal author. As a result, the ministry is forced to recommend an ABSTAIN vote on the matter.
