Can the two of us tackle this? I'm inclined to say that it should not go to trial.

• There is no way to prove Jamie's intent, unless the AG has magical evidence that he is hiding up his sleeve.

I'd say that the recent election make's Ivan's case moot. Either a decision to that effect or a refusal to hear the case as being moot could be done.

But you are right, intent cannot be proved, and, given Ivan's participation in the recent election could be construed that he has acquiesced to the recent election results and therefore abandoned the original claim by participating in the election. See what I am driving at?
