Our constitution and legal system is fatally screwed. It is crafted as well as possible, but the fundamental premise behind it is flawed. It was based on Real Life laws, shoehorned onto a multiplayer game. It was never going to work, and it hasn't.

Over and over again it has been shown to be unworkable. Our courts are the laughing stock of NS, and fine players have walked away from our region in frustration, leaving behind sadder individuals who seem to get an erotic thrill out of inserting their tiny subclauses into a perky and open cocidil.

And yet, proving Einstein's point, we are told that we must do the same thing over and over again, and it will change.

How about a real change?

How about sending TNP in a new direction? One which could, you know, be more fun?

I have been nominated for the position of Supreme Divine Ruler. If elected, I will make these pledges:

1. No purges. I am not wired that way.

2, Exciting roleplay;

3. A new military dynamic, spreading the light of Flemingovianism across the known unverse.

4. Common sense as the basis of decisions.

5. No democracy. That sounds like a bad thing. But democracy does not really work in a game like this. I promise this: I will listen and I will consult before any decision is made. I will endeavour to make decisions reflect the will of the people. But the region needs strong and decisive leadership, and I believe that God is the person to give it.

That is easy. My biggest competitor is the voting booth. You see, in TNP we have a two-stage election process. Even before the voting public gets a chance to choose, the Voting Booth holds their own private election and decides who is allowed to progress.

It is a simple ballot, with only one vote being cast.

If the voting Booth votes for me, then I have every confidence in the wisdom of the TNP public. However, I fear that others do not have such faith in democracy, and that the voting booth will cast his vote against me.

So the Voting Booth is my most dangerous competitor.

Does anyone really believe there would be any point? Justices in TNP have a copy of the constitution rammed so far up their arses they can barely walk straight, let alone use common sense in their judgements. Every time R3N sits down I hear a little whimper of pain.

I could, yes. But I prefer to work through mortals, and allow them to exercise free will.

As far as I know there is no legislation preventing me becoming supreme divine ruler. Is there?

Flem, I think the Election Commissioners may be correct that you cannot run for this position in this election cycle.

There are two election cycles laid out in the constitution - the "general" cycle, in which the offices of delegate, vice delegate, and speaker are filled, and the "judicial" cycle, in which the offices of justice and attorney general are filled. As the position of Supreme Divine Ruler is not any of the aforementioned five positions, it must be filled in a manner other than during the general and judicial election cycles.

As you are seeking to run, it seems clear that you believe the position of Supreme Divine Ruler is an elected one, and not appointed or determined in some other way. Luckily, the Constibillocode does allow for the possibility of elections for offices that are not of the preceding five types: the special election.

The question is, would a special election be appropriate here? There are two questions to consider.

The first is timing. The Constibillocode says,

Vacancies of elected offices are filled through a special election unless a it cannot be completed prior to the beginning of the appropriate scheduled election cycle.

As SDR (I hope you do not mind the abbreviation) cannot fall into a scheduled election cycle, it stands to reason that anytime that position must be filled, it should be a special election and not left empty or filled in any temporary appointed manner.

The real question is not the timing, however, but the issue of vacancy. Is the office of SDR vacant or abandoned??

A "vacancy" in an office occurs when the holder of it resigns, is removed, or abandons it.
An office is abandoned when its holder does not log onto the regional forums for two weeks without prior notice, or when an election winner or appointee fails to post the Oath of Office.

As God, the position of SDR has been yours by default - so has it stood unoccupied? I know for a fact you have not been recalled, nor have you failed to log on for two weeks without prior notice - and I am fairly certain you have not resigned it. The only remaining question I can see is whether you have, perhaps, failed to post an oath of office taking up the position? If you have previously posted such an oath, it is my legal interpretation (however much that is worth) that there is no vacancy in the position of SDR, and, as TNP does not have a system of challenging for occupied offices, a special election would therefore not be appropriate. However, if you have not posted an oath, then the office does indeed stand vacant and a special election must be called within two days to fill it.
