Hail Fellow Resident of The North Pacific!

As you may or may have not noticed, our current honorable delegate is experiencing a period of inactivity. In this scenario it is important to recognize there is no need to panic, especially when doctrine and precedent are clear in these cases.

In order to keep The North Pacific secure, we have a cohort of members ready to position themselves in a defensive posture around the delegate when he is completely dark ( inactive) for more than 48 hours.

Please comply with the above stated doctrine and endorse (if you have not already):

The Honorable Vice Delegate and Military Leader:McMasterdonia

and

The Honorable Top 1 Percent Most Influential:Far Away

Thank you.
Long Live The North Pacific

The Republic of TNP Freedom Fighters

Greetings! Pleased to meet you. I'm writing you about your endorsement of our regional delegate, The Respublika of Zemnaya Svoboda. In particular, I ask you to remove your endorsement of him. Here's why:

1. He hasn't logged into his nation in days, and barely ever logged in even before that. He clearly doesn't care about the region when he is the most inactive delegate of any Pacific in Nationstates.

2. He hasn't been voting on World Assembly resolutions even when the region asks him to do so. Under his leadership, the North Pacific is totally unrepresented in the World Assembly.

3. He runs a Soviet-like regime and holds show trials against nations like John Ashcroft Land and Mallorea. He bans these nations from voting and participating without just cause. In the North Pacific we ought to protect the rights of the most vulnerable.
Therefore, for the above reasons, I request that you unendorse The Respublika of Zemnaya Svoboda.

Thanks!

It appears that there is basis for an indictment on this matter, probably under the impersonation statute, and that as of the current time, both nations still remain within TNP. Anyone who has information in addition to that submitted by Pasargad should submit it in the separate thread I am setting up on this matter in the AG's office within 2 days.

Copied from Complaint thread.

I have bumped the personal message exchange where I transferred the evidence. I wish to leave it in the Attorney General's office's remit when and how to publish, and in what format, any evidence.

Because I didn't have any more time last night. I still have some slicing and dicing to do to separate the wheat from the chaff in the Complaints thread.

Anyone having additional evidence or witness statements concerning this matter should post it, or PM me with the material as soon as possible.

I am in the process of organizing and reviewing the provided information to determine who and what charges should be included in the indictment.

(time=1345058040) <+Gulliver> Is Durk unaware that the legal code was updated
(time=1345058040) <@Eluvatar> > 8. "Sedition" is defined as an intentional attempt to incite the Nations of The North Pacific to revolt in a manner not sanctioned by the Constitution and the Bill of Rights.
(time=1345058040) <@Eluvatar> Gulliver: even the old legal code would apply
(time=1345058040) <@Eluvatar> he sent out telegrams
(time=1345058040) <+Gulliver> Hah
(time=1345058040) <+Durkadurkiranistan> lol yay another trial

(time=1345058040) <@Eluvatar> "in a manner not sanctioned"
(time=1345058100) <@Eluvatar> so if he can argue it falls under free speech he gets off
(time=1345058100) <@Eluvatar> *demonstrate
(time=1345058100) <@Eluvatar> obviously he can argue XD
(time=1345058100) <+Tim> It does argue xD
(time=1345058100) <+Durkadurkiranistan> why wouldn't it?
(time=1345058100) <+Tim> It's totally free speech
(time=1345058100) <@Eluvatar> > 2. Each Nation's rights to free speech, free press, and the free expression of religion shall not be infringed, and shall be encouraged, by the governmental authorities of the region. Each Nation has the right to assemble, and to petition the governmental authorities of the region, including the WA Delegate, for the redress of grievances. The governmental authorities of the region shall act only in the best interests of the Region, as permitted and limited under this Constitution.
(time=1345058100) <+Gulliver> Where was this complaint made
(time=1345058100) <@Eluvatar> Gulliver: "Complaints" thread in AG office
(time=1345058100) <+Gulliver> The last complaint I can see is Punk d's post from yesterday
(time=1345058100) <@Eluvatar> visible from search:
(time=1345058100) <@Eluvatar> http://forum.thenorthpacific.org/se...&s_m=11&s_d=25&s_y=2005&e_m=8&e_d=15&e_y=2012
(time=1345058160) <@Eluvatar> Generally, freedom of speech is understood to have limitations,
(time=1345058160) <+Tim> This is an old complaint though....
(time=1345058160) <+Gulliver> Ah it's from Jul 24
(time=1345058160) <+Durkadurkiranistan> if I was not trying to overthrow the government why would an unendorsement campaign be illegal?
(time=1345058160) <@Eluvatar> like, you can't yell "Fire" in a crowded theatre
(time=1345058160) <@Eluvatar> Similarly, outright laws tend not to be permitted
(time=1345058220) <@Eluvatar> and actually your statements, if deceptive, fall under clause 1.10: Fraud
(time=1345058220) <@Eluvatar> 10. .Fraud. is defined as an intentional deception, by falsehood or omission, made for some benefit or to damage another individual.
(time=1345058220) <+Tim> Actually... is it illegal to yell Fire in a crowded theatre?
(time=1345058220) <+Tim>
(time=1345058220) <+Durkadurkiranistan> they were 100% ceptive
(time=1345058220) <@Eluvatar> Yes, Tim, yes it is.
(time=1345058220) <+Tim> Ah. Okay
(time=1345058220) <+Gulliver> Because people could die
(time=1345058280) <@Eluvatar> "Shouting fire in a crowded theatre" is a popular metaphor and frequent paraphrasing of Oliver Wendell Holmes, Jr.'s opinion in the United States Supreme Court case Schenck v. United States in 1919. The paraphrasing does not generally include the fact that falsely shouting fire to highlight that speech which is merely dangerous and false which can be distinguished from that which is truthful but also dangerous. The quote is used as an example of speech which is claimed to serve no conceivable useful purpose and is extremely and imminently dangerous, as they held distributing fliers in opposition to a military draft to be, so that resort to the courts or administrative procedures is not practical and expresses the permissible limitations on free speech consistent with the terms of the First Amendment of the United States Constitution.
(time=1345058340) <@Eluvatar> "The most stringent protection of free speech would not protect a man falsely shouting fire in a theater and causing a panic."
(time=1345058340) <@Eluvatar> `The First Amendment holding in Schenck was later overturned by Brandenburg v. Ohio in 1969, which limited the scope of banned speech to that which would be directed to and likely to incite imminent lawless action (e.g. a riot). `
(time=1345058400) <@Eluvatar> `According to Fenan, Holmes's change of heart influenced his decision to join the minority and dissent in the Abrams v. United States case. Abrams was deported for issuing flyers saying the US should not intervene in the Russian Revolution. `
(time=1345058400) <+Durkadurkiranistan> who is the AG?

This case is reopened.

The current Attorney General is appalled that former Attorney General, Grosseschnauzer did not bring this case to the courts during his time as Attorney General.

Based upon evidence at my disposal I am requesting that the original complaint against tnp_freedom_fighters be amended to include John Ashcroft Land, King Durkadurkistan, and any alias used by the same.

Attorney Assigned: Punk D

The AG's office is requesting any party with information related to this case to please PM me.

Thank you, PD.

I can see your post, I cannot see the contents of the PM.

Having looked into the PM, the evidence that was discussed by PM that I have not posted in a sealed post here is provided below:

The lastlogin field encodes (time=1343275294), and the "last activity" around that time being "4 minutes ago" when the nation was read by the update, within 12 hours of the time of JAL's confession and corroborating that we saw the changed motto appear right at the time he spoke.

Within that daily dump of course, the motto was "Democracy for the North Pacific!" confirming it was changed the same day JAL confessed to being TNP Freedom Fighters.

[(time=1343237460)] <Durkadurkiranistan> check the motto
[(time=1343237520)] <Eluvatar> "I'm JAL" would be better
[(time=1343237520)] <Bel> Huh
[(time=1343237520)] <Eluvatar> or even "Hi, I'm JAL"
[(time=1343237520)] <Bel> Ok, he is serious
[(time=1343237520)] <Eluvatar> :P
[(time=1343237520)] <Prince_Windsor> lol
[(time=1343237520)] <Milograd> 13:31 Finn throws Nicki Minaj CD's at Milograd. < D:
[(time=1343237520)] <Finn> .....
[(time=1343237520)] <Finn> Can we ban him now? :p
[(time=1343237520)] <Bel> Can we try him for this one?
[(time=1343237520)] * Finn hugs Milograd :P
[(time=1343237520)] <Milograd> 13:30 Finn should totally run in the next TNP election with a Nicki Minaj flag. < This is a good way to lose elections. :p
[(time=1343237580)] <Durkadurkiranistan> i didn't violate any laws
[(time=1343237580)] * Finn wouldn't actually..
[(time=1343237580)] <Bel> Section 1.8. Conspiracy 20. "Conspiracy" is defined as planning, attempting, or helping to commit any crime under this criminal code.
[(time=1343237580)] <Finn> But I would post lots of those types of songs every day :p
[(time=1343237580)] <Eluvatar> Well Bel, I think the only way to get him would actually be under the Sedition statute
[(time=1343237640)] <Eluvatar> and I don't like that kind of prosecution particularly
[(time=1343237640)] <Bel> Section 1.3: Sedition 8. "Sedition" is defined as an intentional attempt to incite the Nations of The North Pacific to revolt in a manner not sanctioned by the Constitution and the Bill of Rights.
[(time=1343237640)] <Finn> One thing I don't get.
[(time=1343237640)] <Bel> 10. “Fraud” is defined as an intentional deception, by falsehood or omission, made for some benefit or to damage another individual.
[(time=1343237640)] <Finn> If Durk is freedom fighters.
[(time=1343237640)] <Finn> why tell them to endo far away?
[(time=1343237640)] <Durkadurkiranistan> that wasn't me
[(time=1343237640)] <Eluvatar> XD
[(time=1343237640)] <Bel> He committed Conspiracy, Sedition and Fraud
[(time=1343237700)] <Durkadurkiranistan> there were two things happening at the same time
[(time=1343237700)] <Eluvatar> Perhaps just to destabilize
[(time=1343237700)] <Durkadurkiranistan> some guy decided to ask everyone to endorse Far Away and McMaster
[(time=1343237700)] <Durkadurkiranistan> that wasn't me
[(time=1343237700)] <Durkadurkiranistan> then I decided to take advantage of the situation and send out my own telegram
[(time=1343237760)] <Eluvatar> "Northern Alert" eh?
[(time=1343237760)] <Prince_Windsor> lol evil
[(time=1343237760)] <Durkadurkiranistan> I was just Freedom Fighters and Chairman Ping
[(time=1343237760)] <Bel> And in doing so committed Conspiracy, Sedition and Fraud
[(time=1343237820)] <Durkadurkiranistan> w/e
[(time=1343237820)] <Eluvatar> "3. He runs a Soviet-like regime and holds show trials against nations like John Ashcroft Land and Mallorea. He bans these nations from voting and participating without just cause. In the North Pacific we ought to protect the rights of the most vulnerable."
[(time=1343237820)] <Eluvatar> That could well make it fraud and sedition, idk
[(time=1343237820)] <Eluvatar> I am amused though that you went after me for not representing us in the WA
[(time=1343237880)] * Asta snickers
