So here's the crux of the issue: Govindia, the current Acting Speaker, has missed 2 consecutive votes in the Assembly, along with a couple of others. When pressed, he stated that he will remove the other members but not himself. You can read the brief here.

His defense is that according to custom and tradition, Speakers have not voted. That's not entirely accurate in that previous speakers have voted "Present." I know that Grosse has. Either way, this is the first time the issue has been brought before the Court and the law is pretty clear in that being a government official doesn't exempt you from your responsibilities in the Assembly.

Article II:
2. Holding other office in the Government does not eliminate Assembly-members from the rights and obligations of Assembly-members.

He missed the consecutive votes and failed in his responsibility as a member of the Assembly, and I believe this came out of a wrong interpretation of the Court's previous ruling on abstentions.
