October 2011 Special Election

Inasmuch as no candidate was elected Vice Delegate at the recent concluded General Election in September 2011, a special election is required to fill the office for the term which will end with the elections in January 2012.

This special election is governed by Section 3 of Law 26. That section provides that:

1. A special election shall be held in the event of a vacancy in any elected office or position in accordance with this Law. A special election cycle shall last for no more than fourteen days, which must be completed prior to the beginning of the next election cycle for the vacated office or position.
2. The Delegate, or if the Delegate is not available, the Speaker, or if the Delegate and Speaker are not available, any Court Justice, shall serve as Election Commissioner for the special election.
3. The period for nominations or declarations of candidacy in the special election shall last for five days, beginning within two days after the vacancy occurs or is noticed.
4. Voting shall begin one day after the period for nominations or declarations has closed. Voting shall last for five days.
5. In all instances, a plurality shall determine who is elected to fill a vacancy. In the event of a tie, the Delegate, or if the Delegate is not available, the Speaker, or if the Delegate and Speaker are not available, any Court Justice, shall cast a tie-breaking vote.

The period for nominations and declaration of candidacy, which lasts for five days shall commence at 1800 GMT/UTC Monday, October 3, 2011. (2:00 pm EDT/ 11:00 a.m. PDT). It will last five days until Saturday, October 8, 2011 at 1800 GMT/UTC, 2:00 pm EDT 11:00 a.m. PDT.

Voting will begin Sunday, October 9, 2011, at 1800 GMT/UTC, 2:00 pm EDT 11:00 a.m. PDT. and conclude five days later on Friday, October 14, 2011 at at 1800 GMT/UTC, 2:00 pm EDT 11:00 a.m. PDT. All other rules and requirements for a regular general election of a Vice Delegate, not modified by Section 3 of Law 26 govern this Special Election.

Verified Candidates will be listed in this post; but this thread may be used for nominations, declarations of candidacies and questions to the Election Commissioner of the Special Election (by law, it is the Delegate).

I would assume so.

As only 26 days have elapsed since my application to return to the Assembly, I am ineligible and will not stand.
 
The Constitution provides that:

7. Candidates for these elected officials must be members of the Assembly for 30 days before nominations begin..

Accordingly, candidates for Vice Delegate must have been members of the Regional Assembly as of September 3rd.
 
Just so I'm clear: If one is a member of the Regional Assembly, one is eligible to VOTE in said election, correct? (regardless of time active, I mean)

Current or outgoing officeholders are eligible, as alll they would need to do if resign their current office if theit term of office hasn't expired before posting an oath as Vice Delegate.

If need be, I'll nominate all of them (so all it would require is one second and an acceptance, or a declaration of candidacy.) I haven't done that yet, but it's a tempting way to move things along. Surely we can one of this fine group of RA members to run.
 
At the time of the elections, we were at peace. Mind you we had several endoswappers knocking at the door but that's not different than right now, is it?
 
Oh indeed JAL did seize power shortly *after* that post.

And yet, if JAL had been appropriately ruled ineligible, it would have been clearer that he had no intention of respecting any laws.

Much as it would have been a shame to have no speaker for a bit, it seems clear what the consequences of completely ignoring the law are.

Indeed that election seems to be a clear argument in favor of the 30 day rule. Given the other problems we have faced, I would still prefer to alter the rule, but it would seem to indicate we need an alternate eligibility requirement to replace it.
 
Blackshear has nominated (declared) himself a candidate, and has been in the R. A. since last October, so he is a qualified candidate.
