Mr.Gaunt for Associate Justice

Mr.Gaunt

TNPer
Why should you vote for Mr.Gaunt as Associate Justice?

I am not a man of long speeches, so that's what I am and will be:

- Neutral (as no member or ex-member of NPG/NPD/NPC/Underground)
- Experienced (as Attorney General and guest jurist)
- Sticking to facts, being able to uncouple judicial analysis from personal feelings or opinions (as educated RL scientist)
- Happy to serve my home region TNP and its Constitution (as long-term citizen and RA member).

Feel free to ask questions, but allow me until Tuesday to respond because I am off for a few days.

Mr Gaunt,

Can you point to an example of your judicial philosophy, including what you see the constution of the region being at this time.

Hypothetical situation: one week before the elections are coming in, you recieve a petition to act on the cold silence you've recieved from a cabinet minister who has yet to take their original oath of office. Would you rule against the defendant on this impeachable offense or find such an ardous trial to be a waste of the region's time since the accused's term will be ending in more or less two weeks?

According to the Constitution,
5. All Nations of The North Pacific have the right to be protected against the abuse of powers by any official of a government authority of the region. Any Nation of The North Pacific has the right to request the impeachment of any official of a government authority of the region in accordance with this Constitution, ....
Since this is the case in the described situation, I will proceed with the trial.

There are also a few other points that make it necessary or reasonable to go ahead, e.g. to emphasize that such violations are pursued, to document the violation of the elected official for future reference, to avoid legal confusion in case the official suddenly takes serious actions,...

My basic judicial philosophy is simple:
- Stick to facts
- Analyse the Constitution and the Legal Code
- Find the matching clauses
- Rule

There might be some cases it will not be that simple as described above. It is then the duty of the court to find out the subtleties of the Constitution or Legal Code, judge what was meant or find a passage that has a wider connection to the trial and then rule accordingly.

The heart of the TNP Constitution is Article 1 and it has proven to work, providing citizens with a good basis for a free and respected life in TNP.
There is of course some room for improvement in the details (e.g. current example justice terms), but it important to see that the core parts stand.
