Call for nomination of Judges

As a citizen and register asemblyperson of this region I hereby call apon the prime minister to nominate members to the Supreme court of the region As specified in the constution
Article 5:
The term of office of the Chief Justice and Associate Justices shall begin on the first day of the months of August and February. Nominations and referendums for the full term shall take place during the months of July and January. The Chief Justice and the Associate Justices shall be nominated by the Prime Minister with the advice and consent of the Cabinet, and during the interim period between the creation of a vacancy in the office of Chief Justice or an Associate Justice and the confirmation and installation of a successor to that office, the nominee shall serve as an acting judicial officer on the Court of The North Pacific and have the authority to exercise the duties and responsibilities of the office.

Art 5.2

D - The appointment must thereafter be approved at a referendum, which shall extend for seven days, of the registered voters of The North Pacific, with the participation of a quorum, by at least a 50 per cent vote in favor of a motion for confirmation. The nomination and referendum election shall be conducted as expeditiously as practicable. If the motion for confirmation fails to receive such approval, then the appointee is not confirmed to serve as a judicial officer, and the Prime Minister shall promptly propose another nominee, with the advice and consent of the Cabinet, who shall act as a judicial officer, subject to approval of a motion for confirmation in a referendum by the registered voters of the Region.

What does this mean? Well the nomination process was originally held up because the Prime Minister at the time (Poltsamaa) did not feel there was a lack of candidates who were both qualified and interested; one obvious choice was schnauzer however he felt fatigued and had RL concerns. Flem didn't really touch on it but I guess the same issue applied here, we simply don't have people who were willing to commit. Which in hindsight was reflective of the times, we had to go out of our way just to fill every Ministry came the election too.

It's funny actually that you brought this up as I had PM'd Tresville about this situation also. Should interested parties be nominated and confirmed by referendum, they would not be beginning a new term but would have to serve only as a replacement candidates for the term which was held by the vacant seat. In other words, those confirmed would actually be finishing a term started in January ending, and up for re-election if they so choose in July!

Possible suggestion, since it would seem convenient right now: Could we amend something to make the Justice terms overlap somewhat? The Chief Justice would be appointed every Feburary and August, and the two Associates every May and November. That way, we're guaranteed to have at least one Justice at all times, and there's always someone experienced in office.
 
Remember, folks, we can nominate all we want to, but it is entirely the Prime Minister's call on who gets appointed, or whether he takes your suggestions into consideration.

A staggered approach is actually a really good idea, I await your RA proposal.

As for you why you; you have an in-depth knowledge of the law as displayed in your original Constitution for Dummies, and you always present a balanced approach in your law writing in the RA. Despite the partisan controversy of your cabinet term, I think we need people who take bold stances on what they feel is right. Forget the "activist judiciary" meandering so carelessly tossed around in the US.
