Including areas which probably are being used for government purposes but their creators super insist aren't? What would you consider the burden of proof for what is or is not within the laws purview?

Is it your belief that our laws do not apply to areas which have been deemed "nongovernmental" by their creator, whomever that creator might be, but are being using for IC purposes? Why or why not?
