The World Assembly,

Recognizing the noble goals of General Assembly Resolution #38 “Convention Against Genocide,” namely in punishing those who commit genocide and offering aid to the victims of genocide,

Concerned by the ambiguity several key clauses of GAR#38, creating disastrous consequences beyond its intended scope in addressing genocide, such as;

• (5)(1) demands that nations “must facilitate the extradition of those suspected of the crimes specified in section 4” (including but not limited to inciting genocide and complicity in committing genocide), but does not require such suspicion to be substantiated on facts or based on a legal conviction, leading to the possibility of individuals being erroneously extradited,
• (5)(2) further specifies that crimes relating to genocide cannot be considered political crimes for the purposes of preventing extradition proceedings, further encroaching on a nation’s ability to defend itself against unjust extradition requests,
• (3) prohibits nations from providing aid to “perpetrators of genocide,” allowing for bad-faith actors to block vulnerable groups from receiving aid by inaccurately labeling them as “perpetrators of genocide” without due process

Alarmed that these problematic clauses can be abused to override the extradition and humanitarian aid policies of the sovereign nations of the World Assembly,

Worried that (5)(1)-compliant extraditions based on sometimes unsubstantiated or malicious suspicions can negatively impact member nations,

Emphasizing the need for solid global legislation targeting those who commit and aid in the act of genocide,

Hereby repeals GAR#38, “Convention Against Genocide”

It’s always tough to target touchy subjects like this, but I have always been of the opinion that if you are going to tackle them, you have a responsibility to do them right and it cannot be a bad thing to repeal them if they fall short. Anything truly worth doing is worth doing right.
