[Draft 2] - Equivalence in Intelligent Lifeforms

The World Assembly (WA),

Acknowledging that the multi-verse may contain an infinite number of intelligent forms of life (such as, merely as examples, organic species of all kinds such as humans), some of which may still be beyond the understanding of the collective wisdom of WA states;

Believing that it is advantageous to give a clear definition to what constitutes an intelligent lifeform, and to require that they be treated equally to other lifeforms in a WA state, in order to advance communications, cooperation and understanding between different lifeforms;

1. Hereby defines:
   1. "Dominant lifeform" mean a form of life (whether it is an organic species or in other forms) that comprise a substantial portion of the national government of a WA state, recognizing that there may be more than one dominant lifeform in a WA state;
   2. "Intelligent lifeform" is defined as a lifeform, howsoever manifested, (such as, merely as examples, physically or electronically) where:
      1. a randomly-selected, fully developed and fully competent member of the said lifeform can conclusively demonstrate:
         1. wisdom;
         2. intellect;
         3. sentience;
         4. consciousness;
         5. the ability to utilize tools and technologies for their needs;
         6. the ability to sustain communications with intelligence with the dominant lifeform; and the ability to
         7. the ability to be self-sufficient in sustaining the life-cycle of the said lifeform; and
      2. multiple fully developed and fully competent members can conclusively demonstrate the ability to be able to, in addition to conclusively demonstrating the abilities stated in clause (1)(b)(i) individually, also collectively form a civilization with significant social, cultural and scientific developments;
   3. A "WA state" means a member of the WA and a "WA government" means all national and sub-national governments of a WA state;
   4. WHA means the World Health Authority;
2. Hereby requires that:
   1. A WA government must recognize another lifeform as an "intelligent lifeform" if a judicial authority (or another competent authority) of the said WA state determine that the said lifeform is an intelligent lifeform as defined above and possess intellect at least equal to, if not superior to, the intellect of the dominant lifeform of the said WA state;
   2. A WA government must also recognize another lifeform as an "intelligent lifeform" if it has been determined as such by the WHA or any other body of the WA, such as (merely as examples) the various judicial bodies of the WA;
3. Hereby mandates that:
   1. No WA state may permit anyone subject to that WA state's jurisdiction, whether belonging to the dominant lifeform or to another lifeform, to discriminate against a fully developed and fully competent member of another intelligent lifeform in any domestic or foreign affairs on the grounds of being of a different lifeform;
   2. A WA state must accord a fully developed and fully competent member of another intelligent lifeform the same rights as it would accord to a fully developed and fully competent member of its own dominant lifeform, provided that such rights are not detrimental for any reason to that other lifeform;
4. Hereby clarifies that this resolution does not interfere with a WA state's rights to segregate different intelligent lifeforms from each other, but only if such rights are exercised strictly for reasons other than discrimination on the grounds of preconceived notions or other prejudices, such as, merely as examples:
   
   1. scientifically valid concerns over diseases upon contact, such as between two organic species with contrasting health issues;
   2. significant differences over physical features posing clear dangers to one of the species involved;
5. Hereby also clarifies that:
   1. A member of an intelligent lifeform in an earlier stage of development (such as childhood) or with impairments to development is still a member of the said lifeform;
   2. For the purpose of WA resolutions, an intelligent lifeform must be deemed a sapient species for the purpose of rights and responsibilities, regardless of whether such lifeform is organic or capable of interbreeding;
   3. Any interpretations on clause 3 or clause 4 shall be made by the independent judiciary or other competent authority of the relevant WA state;
   4. In case of disputes over this resolution between WA states, including between intelligent lifeforms dominant in different WA states, the interpretation(s) and decision(s) of the WA Compliance Commission shall be final.
