Judicial Access Act

The World Assembly,

Convinced that access to civil courts is a fundamental purpose of government,

Concerned that court costs can prevent individuals of limited means from seeking justice,

Determined that no individual should be denied access to civil courts because of their inability to pay court costs,

Recognizing that civil courts adjudicate disputes between private parties and that this resolution does not apply to criminal prosecutions,

Therefore:

Defines "court costs" as any fees, filing charges, service fees, or other expenses required to participate in civil proceedings,

Mandates that member nations cannot deny access to civil courts based on an individual’s inability to pay court costs,

Requires that if court costs are applied, nations must provide waivers or deferrals to ensure that economic hardship does not bar anyone from filing or defending a civil case,

Clarifies that nothing in this resolution prevents courts from dismissing frivolous or litigation or otherwise restricting abusive litigants.
