General Assembly Resolution #299 “Legal Competence” (Category: Civil Rights; Strength: Significant) shall be struck out and rendered null and void.

Determined to uphold the essential values of individual freedom and equal treatment across all member nations,

Acknowledging GA#299’s stated goal that “freedom to make important decisions about one’s life should not be unreasonably restricted”,

Nonetheless, concerned that the resolution in question fails to achieve this goal, as the standards set for when an individual’s personal freedom should be restricted go beyond the limit of what is reasonable, notably:

  • The vague definition of “very low intelligence” in Article 2.1 allows governing bodies within a nation to oppress minority groups by declaring them legally incompetent according to a supposed standard of intelligence, which is especially worrying as there is no objective standard for intelligence or what constitutes “very low intelligence”, making it easy to manipulate this definition for malicious purposes;

  • Article 2.2 specifies that the experts employed to measure compliance with these standards of intelligence must be “allowed by the authorities to act”, making it easy for said authorities to cherry-pick experts whose standards align with their own, even if the experts in question are acting fully autonomously as the target specifies;

  • Article 4, when paired with the above definition and restrictions, allows governments to progressively set thresholds of legal allowance depending on intelligence, opening the door to various forms of discrimination;

Considering the resolution’s incompetence at achieving its stated goals,

The General Assembly repeals “Legal Competence”.
