Repeal: "Medical Facilities Protection"
Category: Repeal | GA #121
Proposed by: sankt-adalbertian states, Co-authored by: gem, picairn, the new ganges | Onsite Topic
Replacement: None

The General Assembly,

Lauding the altruistic motives of this body in adopting the aforementioned resolution,

Concerned, however, that the resolution contains multiple oversights which may lead to more harm than benefit,

Alarmed that Clause 1. Article a. defines “medical facility” as a structure dedicated to preserving life “after the immediate effects of injury or disease”, a very narrow qualifier that excludes facilities no less important to public health, such as those dedicated to research, nutrition, and preventative medicine, from the resolution’s protections,

Shocked that Clause 1, Article b. defines deliberate targeting as an attack on a medical facility "while they in [sic] the performance of their duties", thus enabling the targeting of medical facilities while not actively treating casualties; an oversight that flies in the face of the resolution’s note that “vital infrastructure and supplies [should] remain undamaged”

Discontented by Clause 3, Article a., which waives protections of medical facilities for "stockpiling of non-medical supplies", which is not formally defined and could lead to, among other good-faith actions, the storage of basic humanitarian supplies such as food or water being considered a waiver of protections,

Further disappointed by by Clause 3, Article b., which waives protections for medical facilities and staff upon the unveiling of any "evidence of camouflage or attempt to abuse" regardless of whether that evidence is trustworthy or not,

Noting that the resolution has effectively been superseded by General Assembly Resolution #480 "Wartime Healthcare Protections", which more effectively outlines the conditions and protections that this resolution attempted to implement,

Hereby repeals General Assembly Resolution #121 “Medical Facilities Protection”.
