Request for Court Ruling

Tresville

TNPer
7. Candidates for these elected officials must be members of the Assembly for 30 days before nominations begin.
We need clarification on this matter. Is it 30 days as RA within your time in TNP or 30 days directly before nominations begin.

This may also have a bearing on how we use the "suspended RA Mask."

There is no longer a "Suspended RA" mask, due to the recentt amendment of Law 28 that eliminated the suspension provision that was originally included in that Law.

Official Court Ruling on Election Eligibility
The clause in question, for reference, is:

Art. 1:
7. Candidates for these elected officials must be members of the Assembly for 30 days before nominations begin..

The Court finds that the current wording and original intent of the Constitution is such that all candidates for the relevant positions must be RA members for a continuous 30 Days in the period immediately preceding the nomination process. The Court recognizes that in the previous election this clause was not strictly followed, but maintains that that incident was essentially an extrajudicial mandate from the Regional Assembly, and cannot be used to establish a legal precedent.

If a election calendar could be enacted more than 30 days before nominations opened. or a permanent election cycle calendar of key dates, then this issue would go away. As it is, it's going to raise a due process issue, as I indicated in my dissenting opinion to the opinion of the Court in the last term.
